Reps mull removal of immunity for President, VP, Governor, Deputy Governor

The House of Representatives is expected to commence debate on the general principle of a bill that seeks to remove all forms of immunity clauses conferred on the President, Vice President, State Governors and Deputy Governors in the 1999 Constitution (as amended). The private member bill which passed through First reading on the floor of the House, was sponsored by the immediate past Chairman, House Committee on Army, Hon. Rimamnde Shawulu Kwewum and seeks to amend section 308 of the Principal Act. He maintained that the amendment being proposed will not pre-dispose President, Vice President as well as Governors and Executives to distraction as these are explicitly prohibited. The lawmaker who argued that such immunity exists only in countries with weak democratic structures stressing that immunity for Executives has stunted our development and engendered democracy, hence “removing the blanket immunity clause would increase accountability and open up the creativity of Nigerian people.” While citing the provisions in other jurisdictions, he observed that “there is absolute immunity from civil litigation for official acts undertaken” in the United States of America. “The Supreme Court in the US held that the President does not possess absolute immunity from civil litigation surrounding acts he took before becoming the president. In 2020, the Supreme Court held that the president is subject to subpoenas in criminal prosecutions for personal conduct,” he noted. According to him, in the United Kingdom, immunity from criminal prosecution is not enjoyed by members of parliament. Parliamentary immunity (parliamentary privileges) are allowed. No prosecution for what is disclosed in Parliamentary debates and processes. He further observed that in France, only Parliamentary privileges/immunity are allowed. In Germany, there is only parliamentary privileges/immunity but parliament can vote to lift the immunity for specific members and allow prosecution of the President. In Chile, there is Parliamentary immunity. No immunity for serving Presidents. Prosecutions can commence immediately after leaving office. In Cote d’Ivoire, President is liable for acts done in the exercise of his office, can be prosecuted for high treason; in Fiji Island, there is full unconditional immunity for President, Prime Minister, etc.; in Kazakhstan, there is immunity for the President; in Lebanon, immunity while discharging functions of the office; in the neighbouring Niger Republic, immunity in the exercise of the function of office; No immunity for high treason; in Russia, inviolability of immunity for former and President while in Syria, immunity is granted except treason. According to the proponent of the bill, the proposed amendment seeks to “make the category of persons named and /or referred to in subsection 3 of Section 308 of the Constitution become subject to legal proceedings, whether civil or criminal, during their period of office, that is, whilst holding such office. Currently, Section 308 of the Constitution of the Federal Republic of Nigeria provides immunity for persons holding the office of President or Vice President, Governor or Deputy Governor under subsections (1)(a), (b) and (c); (2) and (3) thereof. In effect, by this Constitutional provision, the restriction is placed on legal proceedings for persons holding these offices under subsection (1) and (2) Section 308 Constitution of Federal Republic of Nigeria. “The amendment proposed here, however, seeks to limit or remove such immunity, whether civil or criminal, provided however that the action and decisions contemplated therein do not relate to such issues as corrupted 0 to the crime of murder, treason, or any other personal crimes committed by the office holder as an individual whilst in or out of office.” While calling for a paradigm shift with the view to outlaw the immunity clause, Hon. Shawulu argued that “Immunity for President and executives presumes that holders of the offices necessarily possess some form of divinity that immunes them from committing crimes and always act according to the law and the Constitution. “Do not have any interest or loyalties that go against the state and its people and re above the law-meaning that the law does not apply to them. The above tenets do not conform to democracy and the natural law of justice. Besides, deifying human beings these regulations have protected heinous crimes against the people and the state. “Increasingly, around the world, the rules of accountability and equality before the law are being strengthened,” he observed. While frowning at the current provision which provides that such public office holders should ‘wait till after tenure’, the Taraba lawmaker “Some well-meaning people have argued that executives should not be distracted; and that, frivolous cases may be brought up against such executives. “The scenario of several cases cannot, however, prevent the strengthening of our system and constitutional framework to increase the greatest good for the highest number of people. Secondly, a chief executive-President or Vice President, Governor or Deputy Governor who commits a criminal offence has already distracted himself. “Furthermore, such a criminal action itself disqualifies him from holding such a position and the very fact that he is suspected by law enforcement agencies and people of having committed such a criminal offence diminishes him and the offence he is occupying in the eyes of reasonable people. “In addition, justice delayed is justice denied: assuming a President or Governor commits rape or murder, what if, lack of immediate prosecution leads to his tampering with witnesses or evidence?” The bill which is expected to be gazetted for Second Reading is to be referred to the Special Ad-hoc Committee on Constitution Review for further legislative action.

Oluwo of Iwo, Oba Abdulrasheed Akanbi has pleaded with President Muhammadu Buhari to prevail on security operatives to leave the popular Yoruba freedom fighter, Sunday Adeyemo aka Igboho alone, saying he has learnt his lessons. The monarch in a letter to President Muhammadu Buhari made available by his spokesperson, Alli Ibrahim on Friday disclosed that the tactics and approach of Adeyemo, popularly called Igboho, has been chastised by royal father’s in the region but sought the president’s magnanimity to let him off the hook in the interest of the nation’s unity, especially having been ready to step down his agitation. He added that hunting down Igboho could lead to suspicion and distrust in the country similar to the situation witnessed after the deaths of Chief Moshood Abiola and Ken Saro Wiwa. “Sunday Adeyemo popularly known as Sunday Igboho earned his popularity as an activist whose joy is to liberate the cheated. He started as such and grew with it. His strategy is not known to me because I’m not in his camp. Whenever I have information about his move, I do call him to order. He visited my palace sometime in 2018. I give pieces of advice when sought. Instead of Igboho to distinctively differentiate between agitation towards government and inter groups activism, he failed. “At a point, he abused stakeholders with spurious allegations. I was the first on the list for drumming support for one Nigeria. As a father, I’ve personally forgiven him. And I’m personally beseeching your Excellency as the number one citizen of the Federal Republic of Nigeria to demonstrate your magnanimity by forgiving our promising son, Chief Adeyemo Sunday Igboho. “He is a novice in handling issues against the government. He is a gift to us in Yorubaland. He has pledged his readiness to listen to us. I appeal to your Excellency to slow down the security trail on Sunday Igboho. I have the assurance that adhering to this piece will go a long way in strengthening the unity of Nigeria. I promise your Excellency that Igboho will mind his steps henceforth. He has suffered a lot. He would step down agitations. I will bring him for a peace talk at the appropriate time. “Liberal struggles are won on intelligentsia merit. Arsenals without strategy is a defeated battle. These and many more, I supposed he has learnt and ready to mend his way. Nigeria is an indivisible entity that cannot be tore overnight for whatever reason. let’s forgive to move on and up. The strength is not only in diversity but also forgiveness”, the statement reads. Oluwo added that Nigerians have seen the might of government when it is ready to tackle any crime, commended the President for his determination to checking banditry and other criminalities across the country. Youths own the future but less equipped -Kumuyi

The Chancellor, Anchor University, Lagos, Pastor William Kumuyi, says Nigeria and other African countries must empower the younger generation to usher in the desired transformation in the nearest future. Kumuyi made this assertion at the maiden convocation ceremony and awards of first degrees and prizes on Friday in Lagos. The convocation ceremony was tagged: “The Emergence of Peculiar Pearls (Class of 2019/2020).” He said African youths were yet to live up to expectations on many fronts, hence the need to train them to unearth and raise their potential. He said millions of young people had their visions crashed through wrong and early marriage and its consequences. “A good number are victims of destructive behaviours like drug abuse, immorality and other crimes. “These gloomy realities explain why Anchor University was established with the vision to be a citadel of learning for holistic human transformation and development. “As an undergraduate at Anchor University, you need integrity to become a total student,” Kumuyi said. He noted that Africa was considered the youngest continent because of its large youth population with about 60 per cent under 25 years. “According to the UN’s demographic projection, the median age in Africa for 102 is pegged at 19.8 “Beyond Africa, young people are very important demography of the world, they own the future but are less equipped for the future. “Nigeria, like the rest of Africa, must become deliberate about quality education to ensure young people are both relevant in the future and competitive globally,” Kumuyi said. Earlier in his address, the Governor of Lagos State, Babajide Sanwo-Olu, lauded the mission, vision and core values of the institution, which he said placed emphasis on character building and spiritual values. Sanwo-Olu, who was represented by his Deputy Chief of Staff, Mr Gboyega Soyombo, also commended the institution for surmounting the challenges of COVID-19 lockdown. “In addition to the spiritual emphasis, there is also the passionate pursuit of academic excellence on a global scale in teaching, learning and research. “This you have aptly demonstrated in the ability to hold lectures and conduct examinations for students during the COVID-19 lockdown. “I want to encourage the university to continue in its service to humanity in terms of education and empowerment in character development of the young people of Nigeria. “If the first four years of the institution has been this productive and inspiring even in the face of the global pandemic, the future of this university is no doubt, very bright,” he said. 130,000 Nigerian Refugees To Return From Niger Republic In December

The Diffa region is home to 300,000 Nigerian refugees and displaced people, according to the UN. Mayor of Johannesburg dies of COVID

Geoff Makhubo, the mayor of Johannesburg, South Africa, has died after contracting COVID-19. Mlimandlela Ndamase, the spokesman of the city, said Makhubo was hospitalised after testing positive for the infection in June. He said the mayor later succumbed to the infection. Makhubo was 53 years old. According to South Africa’s Sunday Times, Eunice Mgcina, acting executive mayor and member of the mayoral committee (MMC) for health and social development, asked mourners not to converge on the home of the deceased. South Africa is battling a third wave of infections and spread of the highly contagious Delta variant of COVID-19. “We had hoped that the executive mayor would beat the virus and return to work and lead the city as we face this pandemic that has devastated lives and livelihoods. Sadly, it was not to be,” Mgcina said. “Our heartfelt condolences go to his wife, daughters, mother and the rest of his family, friends and comrades.” The late Makhubo became mayor in June 2019.

Two mobile policemen and two middle- aged women were killed and several others injured when bandits attacked Komponi Bobi in Mariga local government area of Niger state. It was learnt the bandits came in 17 motorcycles with two persons on each. A source told The Nation after attacking the communities and rustling cows and sheep, the bandits moved to a construction site on the new road of Kompani Bobi where they attacked the police station there, killing two mobile operatives. It was a cascade of tears, whimpering sobs and free flow of emotions on Friday afternoon as the remains of renowned televangelist and founder of the Synagogue Church of All Nations, Prophet Temitope Balogun Joshua, were lowered six feet beneath the ground. The 57-year-old was buried on the premises of his church in Lagos State. He was buried in the presence of his widow, Evelyn; his children, family members and other loved ones. Joshua was buried after a week-long funeral service which climaxed on Friday afternoon. BREAKING: NURTW Vice-Chairman Shot Dead In Lagos

The Vice-Chairman of the National Union of Road Transport Workers (NURTW), Samuel Kayode, popularly known as Ekpo Kinkin, has been killed at the Agboju area of Lagos State. According to reports, Ekpo who was a member of the ruling All Progressives Congress was at a rally organised by the party at Oriade Local Development Area when the gunmen invaded the rally on Thursday and shot him dead. Eyewitnesses said a gunshot was heard from the crowd outside while the meeting was on, forcing residents involved at the rally to scamper to safety. When those inside the hall rushed to the scene, Kayode was found in the pool of his blood. However, NURTW in Lagos State confirmed the incident to The Punch, noting that the deceased was trying to protect a fellow politician when he was killed. “He was protecting a fellow politician, Wale Yusuf, from harassment when the gunmen shot him dead,” said Jimoh Buhari, the spokesman for the NURTW Chairman, Musiliu Akinsanya. The state Police Public Relations Officer, Muyiwa Adejobi, is yet to react to the ugly incident.

Workers stranded as FIRS seals NDDC headquarters in Rivers

This is certainly not the best of times for the Niger Delta Development Commission, as its corporate headquarters in Port Harcourt, was sealed by the Federal Inland Revenue Service. Although the reason behind the sealing could not be immediately ascertained as some staff of the commission seen outside the gate declined comments on the development. Our correspondent, who visited the NDDC headquarters located at the Marine base axis of the Rivets State capital around 11:10 am on Friday observed that the main gate and adjoining walls had over nine stickers with the inscription, “sealed by the Federal Inland Revenue Service.” A security vehicle donated to the police was stationed opposite the main entrance, which carried the bold inscription ‘sealed’. A resident, who simply identified himself as Peter, told our correspondent that the seal was discovered when the staff of the interventionist agency were reporting for work. Peter, who said he runs a business near the complex, describe the development as a shock, saying most workers returned home after waiting in vain to gain entrance for hours. “We saw this seal on Thursday morning when the NDDC workers were coming to work, the situation caused confusion, many workers left while some waited around. “Some workers still came to work today (Friday) and the gate is still sealed, to be honest with you I don’t know why a Federal Government agency would seal off another Federal agency,” the resident said. A couple of months ago, protesting youths under the aegis of the Ijaw Youths Council had sealed the same facility which was commissioned on Match 11, 2021 by the President, Major General Muhammadu Buhari (retd). The youths, who also sealed the Rivers State office of the NDDC located on Olu Obasanjo road, Port Harcourt, said their action was to protest the continued delay by the apex government in constituting a substantive board for the interventionist agency. Efforts to reach the Director, Corporate Affairs of the NDDC, Dr. Ibitoye Abosede, proved abortive, as he neither answered calls put across to his telephone by our correspondent nor replied to a text message sent to him as of the time of filing this report.

How we recovered 43 oil wells from Rivers — Imo govt

The Imo state government yesterday named the areas it recovered 43 oil wells from Rivers State, saying that 22 oil wells were recovered from Mgbede Field in Egbema, Ohaji/Egbema Local Government Area and 21 oil wells from the Akri Field in Oguta Local Government Area in Imo The government disclosed to newsmen in Owerri, through the Senior Special Adviser, SSA, on Public Enlightenment, Stamford Nwokedi, while making some clarifications on the recovered oil wells. He described the recovered oils wells as a boost to the revenue generation of the state. He added that with this development, that Imo has taken a stronger position in the Niger Delta Development Commission, NDDC. According to Nwokedi, the “22 oil wells were recovered from the Mgbede Field in Egbema, Ohaji/Egbema Local Government Area, and 21 oil wells from the Akri Field in Oguta Local government area, with these 43 recovered Imo Oil Wells, Imo State is now the 4th largest oil producing State. “We were before now a fringe member of the Niger Delta Development Commission. Imo State is now an assertive 4th in the rung; an authoritative member of the NDDC And every other month from now to perpetuity, much more revenue comes into Imo coffers.”
