Customs FX rate for import duties rises to N1,530/$

  The Nigeria Customs Service (NCS) has adjusted the foreign exchange (FX) rate for import duties to N1,530 per dollar. This represents a 6.13 percent increase compared to the N1,441.58 adopted on May 6. The rate adopted by customs was observed on Friday on the federal government’s single window trade portal. Customs typically adopt FX rates recommended by the Central Bank of Nigeria (CBN) for import duties based on trading activities in the official FX market. TheCable observed that the NCS rate is marginally lower than the official FX rate of N1,533/$ recorded at the close of trade on May 16. On May 15, the Nigerian currency depreciated to N1,550 against the dollar at the parallel section of the FX market. The parallel FX rate declined by 1.95 percent compared to the N1,520/$ reported on May 13. On May 16, Muda Yusuf, director-general, Centre for Promotion of Private Enterprise (CPPE), advised NCS to set a quarterly exchange rate between N800/$ and N1000/$ for import duties assessment. Yusuf said the continuous fluctuation affects inflation. He said setting a fixed rate was necessary to reduce the pass-through effect of heightening trade costs on inflation.

Buying pre-registered SIM cards criminal, NCC warns

  The Nigerian Communications Commission has warned Nigerians against buying pre-registered SIM cards, citing the illegal nature of the practice, and could attract severe consequences. In an advisory note sighted on its X platform on Friday, the telecom regulator emphasized that the use of pre-registered SIM cards compromises the accuracy of consumer information. “Buying pre-registered SIM cards is criminal and may lead to imprisonment, implication in identity theft, financial fraud, kidnapping and armed robbery,” part of the advisory noted. The NCC explained that using a pre-registered SIM card undermined the reliability of data collected on consumers, making it challenging for authorities to identify and apprehend the actual perpetrators of crimes. The warning aims to educate the public on the risks associated with pre-registered SIM cards and encourage compliance with legal guidelines to enhance national security. The commission urged to follow the proper procedures for registering SIM cards to avoid any legal consequences. In recent times, Nigerian telecommunications companies directed their subscribers to link their SIM cards to their National Identification Numbers. The move, which was initiated by the Nigerian government in December 2020, in a move to streamline the identification process and combat scams. The NCC made the linkage compulsory, directing all telecommunications operators to enforce complete network barring on all phone lines for which subscribers fail to link their SIM cards to their NINs. There have been two phases of barring SIM cards not linked to NIN by the telcos – the first occurred on February 28 and the second one occurred on March 29. The regulator, however, has extended the deadline for linking SIM cards to NIN (last phase) to July 31, 2024, from April 15. This extension applies to subscribers with more than four SIMs.

Lagos court convicts cosmetic surgeon, Adepoju over client’s death

  The Federal High Court sitting in Lagos State has convicted a medical doctor and founder of MedContour Services Ltd., Dr. Anuoluwapo Adepoju, who conducted a failed plastic surgery that resulted in the death of one Nneka Onwuzuligbo in 2020, FIJ reports. This was disclosed by a former Director-General of the Federal Competition and Consumer Protection Commission, Babatunde Irukera on Friday. In his tweet, Irukera, tweeting as #TundeIrukera, wrote, “Today is a day of pride for me that I personally prosecuted Anu Adepoju and her medical practice. Though I’ve left, the case has ended in a conviction strengthening the accountability framework for all in society, professionals or otherwise. NJC Issues Warning Letters To Three Judges, Bars Them From Elevation

  The National Judicial Council under the Chairmanship of the Chief Justice of Nigeria, Justice Olukayode Ariwoola, at its plenary of the 105th Meeting held on 15 and 16 May 2024, resolved to issue warning letters to Justice Inyang Ekwo of the Federal High Court and Justice GB Brikins-Okolosi of Delta State High Court. A statement by the NJC Director of Information, Soji Oye, says Justice Ekwo is warned for abuse of the discretionary power of a Judge by wrongly granting an ex parte order in a suit between Juliet Ebere Nwadi Gbaka & 2 Ors V Seplat Energy Plc & 12 Ors. Justice Ekwo is also barred from being elevated to a higher Bench for two years. Hon. Justice GB Brikins-Okolosi of Delta State High Court on his part, is also issued a warning for failure to deliver judgement within stipulated period in Joseph AneneOkafor Vs Skye Bank, after parties had filed and adopted their final Written Addresses. Justice Brikins-Okolosi will also not be elevated to a higher Bench for a period of three years. The NJC also cautioned Justice Amina Shehu of Yobe State High Court for issuing Writ of Possession Conferring Title on the Defendant in a suit when there was no subsisting judgement of any Court to enable His Lordship issue the Writ. The Council at the meeting considered two Reports of its two Preliminary Complaints Assessment Committees that filtered 35 petitions written against Judges of the Federal and State High Courts and decided to empanel eight Committees to further investigate the petitions that were found meritorious by the Committees. The Council also considered the recommendation of its Interview Committee on Appointment of Judicial Officers of all Superior Courts of Record in Nigeria and resolved to recommend 86 Judicial Officers for appointment to the Court of Appeal, High Court of the Federal Capital Territory, Sharia Courts of Appeal and Customary Courts of Appeal of States in Nigeria. All recommended candidates are expected to be sworn-in after the approval of the NJC recommendations to the President and their respective State Governors.

Muslim group asks Minister to allow marriage of 100 orphaned girls in Niger

  The Muslim Rights Concern (MURIC) has urged the Minister for Women Affairs and Social Development, Uju Kennedy-Ohanenye, to withdraw the litigation and petition she wrote to the Inspector General of Police (IGP), over the proposed sponsor of the marriage of 100 orphaned girls in Niger State. The Chairman, Kano State Chapter of MURIC, Malam Hassan Sani Indabawa, who made the call on Thursday night in a statement, urged Nigerians to learn to respect one another’s culture and traditions.   He recalled that the marriage arrangement in question was sponsored by the Speaker of the Niger State House of Assembly, Hon Abdulmalik Sarkin-Daji, with the event slated to take place on May 24, 2024. The minister on Monday said she had approached a court of law to stop the speaker of the Niger State House of Assembly from marrying off 100 prospective brides and that she had also petitioned the IGP over the Sarkin-Daji’s plan. “We found the harsh and hasty decision taken by the Honourable Minister for Women Affairs over a matter that is entirely beyond the scope of her ministry. “The minister’s attempt at media demonisation of marrying off of 100 poor and orphaned girls, who were largely traumatised for losing both parents to brutal and bloody banditry and insurgency, exposed her ignorance to the culture and traditions of the Muslim North. “This elaborate media blitz, over the matter, MURIC observed, was deliberately done to sway public opinion against the marriage institution, and an attempt to vilify Sarkin-Daji, after demonstrating his genuine concern for the needs of members of his constituency,” Indabawa said. He also recalled that the speaker had explained that he announced plans to support orphaned girls, especially victims of banditry attacks following an appeal by religious and traditional leaders from his constituency. Hon. Sarkin-Daji also said he was surprised at the way the minister tried to smear his name and reputation without any background check or even calling him as a leader, to hear his own side of the story. Indabawa said since her appointment as women affairs minister, she has become famous for some weird public statements, including being seen on TV recently suggesting that children can be engaged in tooth pick, sanitary pads production, thereby promoting child labour which she is supposed to condemn by virtue of her position. He said, “We, at MURIC, therefore, categorically and unequivocally call on minister Uju Kennedy-Ohanenye to immediately withdraw the purported legal case she has filed and equally withdraw the petition she had written to the IGP to avoid an imminent embarrassment because, in this matter, no law has been breached and no coercion was ever to be established.”

This video was also circulated on many WhatsApp groups few days ago. In the video, a United States lawmaker was seen strongly criticizing the bill. “Are human beings yours to buy and sell? Are they? Can you answer that question?” the lawmaker asked Democrats during a fiery speech on the House floor. Verification To verify this claim, first crimefacts.news did a simple Google image reverse search to know the identity of the lawmaker in the video. We found out that the lawmaker in the video is Walter Hudson. an American politician serving in the Minnesota House of Representatives since 2023. However, the practice exists as a private arrangement, meaning the legal system does not have authority to enforce surrogacy agreements between individuals. Passed by House Democrats on Monday night, HF 3567 would establish a legal framework for the surrogacy process.   HUMAN rights lawyer, Mr Femi Falana, SAN, yesterday, insisted that the police and other security agencies lack the power to arrest, detain and prosecute Nigerians over cyberstalking. Falana, who called for the discontinuance of all pending cases filed on Section 24 of the Cybercrime Act 2015, added that the Economic Community of West African States, ECOWAS Court, had declared Section 24 of the Cybercrime Act 2015 illegal.   According to him, the ECOWAS court had also directed the Federal Government to amend the section to conform with the rights of Nigerians to freedom of expression. In a statement, the rights activist said: “It has become illegal to arrest journalists for cyberstalking, insult, causing annoyance, offensive message and criminal intimidation. “Section 24 of the Cybercrime Act, 2015 had criminalised ‘cyberstalking’, ‘insult’, ‘causing annoyance’, ‘sending offensive messages’, and ‘criminal intimidation’ ‘insult’, ‘causing annoyance’, ‘sending offensive messages’, and ‘criminal intimidation’. Specifically, section 24 provided as follows: (a) Any person who, knowingly or intentionally sends a message or other matter using computer systems or network that (a) is grossly offensive, pornographic or of an indecent, obscene, or menacing character or causes any such message or matter to be so sent; or (b) He knows to be false for causing annoyance, inconvenience danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, ill will or needless anxiety to another or causes such a message to be sent: commits an offence under this Act and shall be liable on conviction to a fine of not more than N7million or imprisonment for a term of not more than 3 years or to both such fine and imprisonment. “However, in the cases of Laws and Rights Awareness Initiative (Suit No. ECW/CCJ/APP/53/18) and Socio-Economic Rights and Accountability Project (Suit Laws and Rights Awareness Initiative (Suit No ECW/CCJ/APP/09/19), the Ecowas Court declared section 24 of the Cybercrime Act 2015 illegal and directed the federal government to amend the section to make the law conform with the fundamental rights of Nigerian citizens to freedom of expression guaranteed by section 39 of the Constitution of the Federal Republic of Nigeria,1999 and article 9 of the African Charter on Human and Peoples Rights (Ratification and Enforcement) Act, Laws of the Federation of Nigeria 2004. “In line with both judgments of the Ecowas Court, the Government of Nigeria has repealed section 24 by removing the provisions relating to ‘cyber stalking’, ‘insult’, ‘causing annoyance’, ‘sending offensive messages’, and ‘criminal intimidation’ from the Cybercrime Act 2015 and replaced same with Section 5 of the Cybercrime Amendment Act which provides as follows: Any person who knowingly or intentionally sends a message or other matter using computer systems.
