Yahaya Bello loses bid to hear N80bn fraud case in Kogi

  The Chief Judge of the Federal High Court, Justice John Tsoho, has declined the request to transfer the N80.2bn fraud trial of ex-Kogi State governor, Yahaya Bello, from Abuja to Kogi State. The CJ, in a letter dated July 2 and signed by his Special Assistant, Joshua Aji, said he agreed with the Economic and Financial Crimes Commission that Bello should be tried in Abuja and not Kogi State. Justice Tsoho rejected Bello’s application dated June 10, praying that his trial for alleged N80.2bn fraud should be transferred to Kogi. Bello’s lawyer, Adeola Adedipe (SAN), had on June 27 told the trial judge, Justice Emeka Nwite, that his client had applied to have his case transferred to Kogi. Adedipe said Bello took the decision to seek the transfer of the matter after he was briefed about what transpired at the June 13 proceedings in court. Adedipe said, “After the proceeding on that day, we gave him (Bello) the report of what happened in court. I was made to understand that a letter had been written on behalf of the defendant to the honourable Chief Judge of the FHC requesting in substance that this matter be administratively transferred to the FHC Lokoja judicial division believed to have territorial jurisdiction. “This issue is no longer in the hands of the Bar but the bench. If the honorable Chief Judge has taken an initiative, I need to give him the necessary respect.” But the prosecuting counsel for the EFCC, Kemi Pinheiro (SAN), expressed displeasure about the attitude of the defence, insisting that Bello ought to have been in court for his arraignment. Pinheiro also opposed Bello’s bid to have the case moved to Kogi State. In his letter to the counsel, the CJ said he agreed with the EFCC that the case should be tried in Abuja. In the letter, the CJ’s SA, Aji, wrote: “I am directed by His Lordship, the Honourable, the Chief Judge to inform you that he has considered your arguments in support of the application for transfer of the defendant’s case from Abuja to Lokoja and the response of Dr. ‘Kemi Pinheiro, SAN, to the same. “His Lordship’s position on the matter is as follows: “The main complaint in the case borders on the alleged conversion and transfer of funds of Kogi State to Abuja, the Federal Capital Territory, to purchase property through acts of concealment. “The law permits the filing of the charge either in Abuja, FCT or in Lokoja, Kogi State, the offence(s) having been allegedly partly committed in both places. Hence, this is distinguishable from IBORI v. F.R.N. (2008) LPELR8370 or (2009) 3 NWLR (Pt. 1127) C.A. 94 and other judicial authorities relied upon by the defendant. “The prosecution has shown, with documentary evidence, that two criminal charges in the same scheme of alleged fraud leading to the charge against the defendant were earlier filed and are being tried in the Federal High Court, Abuja in Charge No. FHC/ABJ/CR/550/22 F. R. N. v. 1. Ali Bello, 2. Dauda Suleiman and F. R. N. v. 1. Ali Bello, 2. Abba Daudu, 3. Yakubu Siyaka Adabenege, 4. Iyadi Sadat. “In both charges, a formal application was made for their transfer to Lokoja, but the court, in a considered ruling, refused the application. The ruling has not been set aside and cannot be reversed by administrative fiat. “There is documentary evidence of a pending appeal in Yahaya Adoza Bello v. F. R. N. filed on 17/05/2024, wherein the defendant as appellant sought a consequential order remitting the case to the Chief Judge for reassignment. It is not proper to take any step that will be tantamount to pre-empting the outcome of the appeal.” The CJ also considered the issue of jurisdiction. “The main issue raised is jurisdictional in nature and will be more appropriately decided by the court. The matter should, therefore, be presented in the open court. “Please, accept the esteemed regards of His Lordship, the Honourable, the Chief Judge,” Aji added. Bello has been having a running battle with the EFCC over alleged N80.2bn fraud. The anti-graft agency had declared his wanted following his repeated absence in court for his arraignment. At the June 27 proceedings, the EFCC lawyer, Pinheiro, had urged the court to jail Bello’s lawyer for reneging on their commitment to produce him in court for his arraignment. Pinheiro said, “Since no reason has been offered by Adeola (for Bello’s absence), Your Lordship should treat this as professional misconduct and contempt of court. “We urge the court to exercise disciplinary jurisdiction over the lawyers so as to preserve the integrity of the judiciary. “If a Chief Justice of Nigeria can be put in the dock before an inferior tribunal, who then is a SAN or a former governor in terms of status?” Justice Nwite adjourned till July 17 for ruling.

Police detain man who climbed mast for attempted suicide

  The Federal Capital Territory Police Command said a man identified as Shuaibu Yushau has been arrested and detained for attempted suicide. Yushau climbed a broadcast mast owned by Aso Television and Radio in the Katampe area of the Federal Capital Territory, Abuja on Monday. The man had climbed the mast to protest against insecurity and hardship in the country. The FCT Police Command’s spokesperson, Josephine Adeh, in a statement, said Yushau confessed that he had been observing the mast for about a week before deciding to climb. The statement was titled, “Aso Radio Mast climbing: Man arrested for attempted suicide.” She said, “Following a distress call from concerned citizens about a young man who climbed a very high mast with a placard at ASO Radio in Katampe at about 09:10 a.m, the operatives of the FCT Police Command swiftly mobilised to the location. “With much professional persuasion from the police operatives, the man later identified as Shuaibu Alhaji Yushau was prevented from taking his own life. “He claimed to have been observing the mast for about a week before deciding to climb it. The suspect is presently in police custody and a stable condition.”

Court Bars Rivers Chief Judge, Clerk From Dealing With Amaewhule-Led Assembly

  A Rivers State High Court sitting in Port Harcourt, the state capital, has issued an ex parte Order of Interim Injunction restraining the Chief Judge of the State and the Clerk of the Rivers State House of Assembly from dealing with the Martin Amaewhule led House of Assembly. The order which was issued by Justice Stephens Jumbo of the state high court also restrained the duo from dealing with Amaewhule and 24 others as members of the Assembly, and from acting on any resolutions, articles of impeachment, and or any other communications from them. The suit filed by the attorney general of the state and the governor as first and second plaintiffs, and marked PHC/2177/CS/2024 had Martin Amaewhule and 24 others as the first and second defendants. It also has Victor Oko-Jumbo, and others, Chief Judge of the State, Clerk of the State House of Assembly and People’s Democratic Party (PDP) as second sets of defendants. The court further ordered all parties to maintain the status quo ante litem as of July 5, 2024, until the motion for an interlocutory injunction is heard and determined. The order read partly: “That an Order of Interim Injunction is hereby made restraining the 31″ and 32nd Defendants from dealing or howsoever relating with the 1st-27th Defendants as members of the Rivers State House of Assembly and from receiving, forwarding or howsoever acting on any resolutions, articles of impeachment or other Defendants pending the hearing and determination of the motion on notice for interlocutory injunction already filed herein. “That the parties to this suit are hereby directed to maintain the status quo ante litem in this suit as of 5th July 2024, pending the hearing and determination of the motion on notice for interlocutory injunction already filed herein. “An Order is hereby made for substituted service of the originating and other processes in this suit on the 1st-30th Defendants by pasting the same at Quarters, opposite former NDDC headquarters, off Aba Road, Port Harcourt, Rivers State.” The court adjourned to the 15th of July 2024 for hearing.

BREAKING: Bandits Kidnap 25 Persons In Katsina Community

  Bandits dressed in a ‘Hijab’ otherwise known as Abaya have kidnapped 26 persons mostly women and children in an attack on the Runka community of Safana Local Government Area, Katsina State. Runka community is just a few kilometres away to the dreaded Rugu Forest which has over the years been harbouring criminals. A source in the community told Channels Television in a telephone call on Monday that the hoodlums invaded the area on Saturday night at about 10:00 p.m. He said the assailants shot sporadically in several places around the community. He claimed that the attack was a result of the activities of bandits informants who are mostly residents of the communities. “The bandits killed nobody in the community except one person who was shot and injured after he attempted to run. As I am speaking to you, he has been hospitalised. “They abducted at least 25 people because even among my relatives, twelve persons were abducted. “There was no security personnel presence during the attack which lasted for hours until after the incident when an armored personnel carrier attached with some police personnel was deployed to patrol the area. “The bandits stationed themselves everywhere in the community. They moved from house to house, breaking and burgling the entrances and taking the occupants to the forest. “During the attack, one of the bandits was overheard having a telephone conversation with an unknown informant telling him that, “Today, we’ve come to your hometown’.” Police authorities in the state are yet to confirm the incident as the spokesman of the command Abubakar Sadiq did not respond to the inquiries from Channels Television. But the chairman of Safana Local Government Area Abdullahi said 22 persons were abducted, though some have managed to escape. “The DPO Safana has deployed and stationed his team alongside soldiers to the area and they have already commenced a rescue operation,” he stated.

FG suspends taxes on maize, wheat, rice, other staples

  The Federal Government has announced the suspension of duties, tariffs, and taxes on some essential food items imported through land and sea borders. The Minister of Agriculture and Food Security, Abubakar Kyari, made this known during a press briefing at the National Press Centre, Abuja on Monday. Kyari disclosed that the listed food items, which include maize, wheat, husked brown rice, and cowpeas, will enjoy a 150-day Duty-Free Import Window. He added that the move is part of the Presidential Accelerated Stabilization and Advancement Plan, which is aimed at achieving food security and economic stability in the country.   The minister stated that the government has been working tirelessly to address the food inflation crisis, which has seen prices skyrocket to unprecedented levels. Kyari, therefore, assured Nigerians that the government is committed to achieving food security and ensuring that no citizen goes to bed hungry. He said, “The Federal Government has announced a 150-day Duty-Free Import Window for Food Commodities, suspension of duties, tariffs and taxes for the importation of certain food commodities (through land and sea borders). These commodities include maize, husked brown rice, wheat and cowpeas. “Under this arrangement, imported food commodities will be subjected to a Recommended Retail Price (RRP). “I am glad to reiterate that the Government’s position exemplifies standards that would not compromise the safety of the various food items for consumption. “In addition to the importation by the private sector, the Federal Government will import 250,000MT of wheat and 250,000MT of maize. The imported food commodities in their semi-processed state will target supplies to the small-scale processors and millers across the country.” Kayir also said the federal government has also inaugurated the Renewed Hope National Livestock Transformation Implementation Committee to develop and implement policies that prioritize livestock development and align with the National Livestock Transformation Plan.

Court denies IBD Dende’s request to stop Soyombo, FIJ publications about him

  A Federal High Court sitting in Abuja on Tuesday, denied businessman Ibrahim Dende’s request to prevent an investigative journalist, founder of the Foundation for Investigative Journalism, Fisayo Soyombo, from writing further about him. The court declined to hear the application but instead directed the claimant’s counsel to put the defendants on notice. Dende filed this request as part of his lawsuit against Soyombo and the FIJ following an undercover investigation that portrayed him as a “smuggler and gunrunner.” A certified true copy of the court’s proceedings from May 21 revealed that IBD Dende had previously sought an ex parte order to restrain Soyombo, FIJ and Arise from further defamatory publications before serving court processes on them. The court declined to hear the application and instead instructed the claimant’s counsel to notify the defendants. Soyombo, in response to repeated complaints about Nigeria’s porous borders, investigated by attempting to illegally import 100 bags of rice from the Republic of Benin into Nigeria. He succeeded without any security resistance, using information from corrupt Nigeria Customs Service officials who betrayed patrol teams by informing smugglers of their colleagues’ schedules and the optimal times for smuggling. His report, titled “Undercover As A Smuggler,” also implicated Dende as the biggest smuggler in the South West and was followed by several tweets about smuggled goods mentioning Dende as the mastermind. On May 3, Dende, known as IBD Dende, filed a lawsuit for alleged defamation against Soyombo, FIJ and Arise Group after the television station aired the smuggling documentary. During the resumed hearing on July 2, Justice Binta Mohammed of the FCT High Court, Abuja Judicial Division, heard IBD Dende’s application for an interlocutory injunction to restrain the defendants from further defamatory publications. In the written argument submitted by Dende’s counsel, it was contended that the first and second defendants had consistently defamed and maligned Dende’s character. It was alleged that Soyombo continued to publish statements about Dende as recently as June 3, subjecting him to a social media trial while the lawsuit was still pending. Hence, counsel argued that the court needed to grant an injunction to stop the “continuous and daily defamatory publications” against the claimant, pending the final determination of the suit.   He asserted that the right to freedom of expression under the constitution does not permit any journalist to defame someone’s character, discrediting the viral video published by FIJ, which labelled Dende as a smuggler and gunrunner. In the affidavit filed in response to FIJ, Dende maintained that the video showed nothing more than a “verbal altercation” with customs officers and could not be concluded to involve smuggled goods belonging to him. He stated that he is a licensed customs clearing and forwarding agent, whose job is to facilitate the transport of goods into and out of Nigeria. Contrary to IBD Dende’s application for an injunction, FIJ affirmed the truth of its publications about Dende, urging the court to dismiss the application. They argued that the injunction was unconstitutional, as it sought prior restraint of the press and would stifle press freedom. In the written argument submitted on behalf of Soyombo and FIJ, their counsel contended that suppressing the press before a trial violates the constitutional right to free speech and freedom of the press. They stated that the press has a public duty to expose wrongdoing and should not be subjected to censorship or restrictions in the public interest. The counsel also argued that granting the application for an injunction to prevent further libel would prejudice the main suit by implying that previous publications were defamatory and required halting further defamatory content. The counsel added that IBD Dende, who had admitted under oath to assaulting law enforcement officers, did not deserve the equitable relief of an injunction against the press. FIJ contended that those who seek equity must do so with clean hands, stating that ranting an injunction in favour of a party who has engaged in such misconduct, as shown in the video, would be a “perverse incentive.” Soyombo and FIJ have also filed a defence to the main suit along with a list of witnesses to testify. The counsel concluded their arguments, and the court reserved its ruling on the application for an interlocutory injunction to a later date, which will be communicated to the parties.

Amaewhule-Led Assembly Gives Fubara 7 Days To Represent 2024 Budget

  The Rivers State House of Assembly led by Martin Amaewhule has issued a 7-day ultimatum to Governor Siminalayi Fubara to represent the 2024 budget to the House. The order follows the first sitting of the pro-Wike House on Monday after some months. The other House led by Victor Oko-Jumbo is also holding a parallel sitting. Fubara had earlier presented the budget to the House loyal to him when his current Chief of Staff Edison Ehie presided as the Speaker. Ehie and the other pro-Fubara lawmakers passed the budget estimates, and the governor signed the bill into law. He stated that it is aimed at promoting economic development, inclusive growth, and addressing socio-economic inequality in the state. Details later…

Kidnapped Catholic priest in Zamfara released after two weeks

  The Parish Priest of St. Raymond Catholic Church Damba, Gusau, Zamfara State, Mikah Suleiman has regained his freedom from bandits who kidnapped him two weeks ago. Suleiman’s release was announced in a statement on Sunday, July 7, 2024, by the Director of Communications, Catholic Diocese of Sokoto, Pascal Salifu. The statement read, “We are overjoyed to announce the safe release of Fr Mikah Suleiman, who was kidnapped on 22/06/2024. ‘We extend our heartfelt gratitude to God for His protection and to everyone who offered prayers and support during this challenging time.   “Our thanks also go to the authorities and all involved in securing Fr Mikah’s release. He is currently receiving the necessary care and support.” Salifu urged people to “continue to keep him in your prayers as he begins his recovery.” The state Police Public Relations Officer, Yazid Abubakar confirmed the priest’s abduction on Saturday, saying, “Yes, the incident happened early hour of today, the Reverend Father was kidnapped in his residence. We were not informed when the incident happened but what I gathered was that the man stays alone not in the church. “We have deployed our tactical squad to go after the kidnappers with the aim of rescuing the victim unhurt.” More so, the acting Chancellor of the Sokoto Catholic Diocese, Nuhu Iliya had urged the Christian faithful to pray for the “quick and safe release” of the priest. “We equally commend him to the powerful intercession of the Blessed Virgin Mary, Mother of Priests, for his speedy release from the hands of his abductors,” Iliya said. In early June 2024, bandits abducted the presiding priest of St. Thomas Parish, Zaman Dabo Community in Zango Kataf Local Government Area of Kaduna State, Gabriel Ukeh.
