Court halts Orji Kalu’s retrial

Inyang Ekwo, a judge of the federal high court in Abuja, has ordered a stay of proceedings in the N7.1 billion fraud case against Orji Uzor Kalu, former Abia state governor. The EFCC had preferred a 36-count charge against Kalu and Ude Jones Udeogu, a former director of finance and accounts in Abia in 2007. While the former governor bagged 12 years imprisonment in December 2019, Udeogu was sentenced to 10 years in prison. However, the supreme court on May 8, 2020 voided the trial and ordered a retrial after an appeal filed by Kalu’s co-defendant. But Kalu in an ex parte application, sought the leave of court “to apply for an order of prohibiting the federal republic of Nigeria through the EFCC its officers, servants, others, agents, privies and any other person or bodies deriving authority from the federal republic of Nigeria, from retrying him on charge No. FHC/ABJ/CR/56/2007 between FRN vs Orji Kalu & 2 ors or any other charge based on the same facts de novo, there being no extant judgment and ruling of a competent court in Nigeria mandating same”. Kalu said he was exempted from the retrial order of the supreme court as it was particular to his co-defendant. He said it will amount to double jeopardy if he is subjected to a fresh trial on the same charge. Ruling on the application on Monday, Ekwo granted leave to the defendant to pursue his application seeking to stop his retrial. Ekwo ordered a stay of proceedings until the determination of the application.

Afolabi Samuel, a pastor of Winners Chapel, has been sentenced to three years in prison by a Lagos state special offences court for stealing $90,000 and N4.5m belonging to the registered trustees of the church. The pastor was arraigned before Mojisola Dada, the judge, on two counts of conspiracy and stealing by the Economic and Financial Crimes Commission (EFCC). The EFCC said Samuel, who is the church’s treasurer, and Blessing Kolawole, an employee of Covenant University and currently at large, took advantage of their positions to steal the money and convert it to their personal use. The offences contravened sections 278, 285 and 490 of the criminal law of Lagos state No. 11, 2011. Advertisement Dada, delivering her judgment, found Samuel guilty of the charges. In a bid to lessen to the penalty, Rotimi Ogunwuyu, the convict’s counsel, pleaded with the court to temper justice with mercy. He also pointed out that Samuel was responsible for his children’s education and care of his aged parents. Owing to the counsel’s plea, the judge granted the convict an option of N1m fine and ordered him to refund the sum of $90,000 and N2,358,000 to the church.

Bitcoin hits record near $45,000 after Tesla investment

Bitcoin hit a record high near $45,000 on Monday after Elon Musk’s electric carmaker Tesla invested $1.5 billion in the digital currency. Bitcoin hit $44,795.20 around 1325 GMT, before cooling slightly to $44,207.95. The cryptocurrency is up by around 50 per cent since the start of the year. “This is probably one of the biggest developments for the cryptocurrency industry,” noted Fawad Razaqzada, analyst at ThinkMarkets. “Tesla is going to be a major player in the auto industry and if it starts accepting bitcoin as a form of payment, it will give the digital currency further legitimacy.” Tesla’s announcement, in a US Securities and Exchange Commission document, is a sign of confidence in the cryptocurrency that regulators are concerned could be used for illegal transactions. “As more and more companies start accepting bitcoin, this will only lead to further increases in demand in a market which is limited in supply,” Razaqzada added. “Therefore, the long-term outlook on bitcoin remains bullish even if it is starting to look quite expensive in fiat currency terms.” Tesla’s move comes after CEO Musk last week changed his Twitter bio to read simply “#bitcoin”. Just 12 years old, bitcoin has seen a meteoric rise since March, when it stood at $5,000, spurred by online payments giant PayPal saying it would enable account holders to use cryptocurrency. A number of central banks have responded to the rise of cryptocurrencies and the dwindling global use of cash by announcing plans for bank-backed digital units. Unregulated by any central bank, bitcoin emerged as an attractive option for investors with an appetite for the exotic — although criminals have also picked up on its under-the-radar appeal. Debate has raged over the status of the digital asset, launched in late 2008, as to whether it should be seen as a form of money, an asset or a commodity. After the unit — worth a handful of cents in late 2008 — surpassed $1,000 for the first time in 2013, it increasingly began to attract the attention of financial institutions and has experienced wild price swings. Tesla’s move is “the kind of backing that can take bitcoin through $50,000”, remarked Neil Wilson, chief market analyst at Markets.com. It nonetheless raises “questions for fund managers who may not want to invest in a company with this kind of risk on its balance sheet — we know bitcoin is very volatile”, he added. (AFP)

Petrol price may hit N190 as oil nears $60

The upturn in global oil prices last week has again brought to the fore marketers ’ concerns over the non- implementation of the full deregulation of the downstream petroleum sector as the pump prices of petrol have been left unchanged for more than two months . Top officials of two major marketers’ associations who spoke with our correspondents on Saturday said the continued increase in oil prices had brought back petrol subsidy . Recall that on January 11 that the sustained increase in global crude oil prices had pushed up the landing cost of imported petrol closer to the current pump prices of the product in Nigeria , and appeared to have triggered a return to petrol subsidy era . Since November 13, 2020 when the pump prices of PMS were last increased in the country , the price of the international oil benchmark, Brent crude , has increased by 43 per cent , rising from $41. 51 per barrel to $59. 34 per barrel on Friday. Fuel marketers had in December expected another upward adjustment of PMS prices to reflect the further rise in crude oil prices , which closed at $51. 22 per barrel on December 31. However, a N 5 reduction in petrol price, effective December 14, was announced by the Federal Government – a development that left them reeling in shock and questioning the deregulation of petrol price. Crude oil price accounts for a large chunk of the final cost of petrol, and the country has continued to spend so much on petrol imports for many years amid low domestic refining capacity. According to the marketers , the pump price of petrol should be between N 185 and N 200 per litre. The product is currently sold at between N 160 and N 165 per litre at many filling stations in Lagos . The Executive Secretary /Chief Executive Officer , Major Oil Marketers Association of Nigeria , Mr Clement Isong, said , “ Members of my association are operating in Nigeria and care about the long -term sustainability of the industry as well as the country itself . “ So , we know that depending on what exchange rate you use , the pump price should be between N 185 and N 200 per litre. “ For as long as we continue to sell the product at what we are currently selling it, then somebody is bearing the cost of subsidy , and the country really cannot afford subsidy at this time. ” He said the demand for petrol had increased significantly in the country, adding that the security of supply had been threatened. Isong said smuggling might have resumed because of the significantly different prices across the borders, which were recently opened . “ So , we need to completely restructure our entire supply chain. We need to reach a place where , if deregulation takes effect , refining will resume in Nigeria . We need to find a way of making sure that Nigerians benefit from deregulation. That , I believe, is what the discussion must be. ” The Nigerian National Petroleum Corporation , which has been the sole importer of petrol into the country in recent years, is still being relied upon by marketers for the supply of the product despite the deregulation of the downstream petroleum sector. Private oil marketing companies have continued to lament that their inability to access foreign exchange at the official rates has hampered efforts to resume petrol importation. The PUNCH reported on Friday that the Federal Government had announced the commencement of discussions with representatives of the labour movement on how to raise the freight rate from N 7. 51 per litre to N 9. 11 per litre. Freight is one of the elements that make up the landing cost of the petrol imported into the country. The National Operation Controller, Independent Petroleum Marketers Association of Nigeria , Mr Mike Osatuyi , told our correspondent that the implementation of the new freight rate would lead to petrol price increase . He said , “ Already , we are back to subsidy , and from the information I have which is confirmed , the Federal Government is subsidising about N 1. 8bn per day because 70 million litres are being pumped out every day now because the borders have been opened ; I don’ t know where the fuel is going . “ Government cannot afford subsidy , and there is no subsidy in the budget . So , the market fundamentals have to come to force now . “ Based on $56 per barrel of crude oil , our pump price should be about N 186 to N 190. But now that oil price has even gone to $59, then pump price should not be less than N 200 per litre. There is no way Nigerians can avoid petrol price increase . ” Osatuyi said the increase in oil prices had already pushed up the pump prices of diesel and kerosene in the country. The Minister of State for Petroleum Resources , Timipre Sylva, had said in September last year that the Federal Government had stepped back in fixing the price of petrol, adding that market forces and crude oil price would determine the cost of the product. The Federal Government removed petrol subsidy in March 2020 after reducing the pump price of the product to N 125 per litre from N 145 on the back of the sharp drop in crude oil prices. The price reduction lasted till June . Nigerians saw increases in the pump prices of petrol in four months , rising from N 121. 50-N 123. 50 per litre in June to N 140. 80- N 143. 80 in July , N 148-N 150 in August , N 158- N 162 in September and N 163-N 170 in November. Apart from the increase in global oil prices , the devaluation of the naira last year also led to a significant rise in
