Anambra 2021: ADC urges INEC to disqualify APGA, APC, PDP

The National Chairman of the African Democratic Congress (ADC), Chief Ralphs Okey Nwosu, has advised the Independent National Electoral Commission (INEC), not to allow the All Progressive Grand Alliance (APGA), All Progressive Congress (APC) and the Peoples Democratic Party (PDP), to participate in the forthcoming Anambra governorship election. He alleged that the three parties were behind the political, security and socio-economic challenges Ndi-Anambra and the country at large are currently facing. Nwosu, gave the advice while speaking to journalists at his residence in Awka, Anambra State capital, on Tuesday, on the state of the Nation and to felicitate with the Muslims on this year’s Eid-el-Kabir celebration. ‌ According to him, it would be a great injustice to Nigeria’s electoral process, especially, Anambra voters, if the ruling APGA, APC, and the PDP, were allowed to participate in the election. He noted that the aforementioned political parties displayed gross indiscipline and leadership deficit in their processes of conducting primary elections of their different political parties; which, he argued made them unfit, in the eyes of the law, to participate in the exercise. “Everybody in Anambra and Nigeria is a witness to what happened in Anambra as far as the primaries of APGA, APC and PDP are concerned. These three parties have shown gross indiscipline and leadership deficits, which manifested in the ways they conducted their party primaries ahead of the election”, Nwosu stated. According to him, ‘going by records, these three political parties should not participate in the process. What happened in the APC primary was an ambush. The party opted for a direct primary; but at the end of the day, a candidate emerged without anything like primary taking place anywhere. This is a violation of the APC Constitution and the Electoral Act. “For APGA, up till today, the party still has three factions; producing 3 candidates through three different processes. Apart from going contrary to APGA Constitution, APGA also went against the Electoral Act in the conduct of their primaries. So, INEC was right when it said that there was no clear congress that produced delegates for the APGA primary. “For PDP, the story is the same. Every day, the party continues to change techniques of doing their primary. Today, they will say Adhoc delegate; tomorrow, super delegates; the next, nominal delegates. As far as we’re concerned, the only party that followed due process in selecting its candidate for the Anambra guber is the ADC,” he said. He disclosed that ADC in the Anambra election, through the willingness of the people, would throw off the third force and emerged the winner of the election. He also stated that ADC is the third-largest political party in Nigeria with 5 House of Representative Members at National Assembly, Abuja. According to him, if by November 6, Anambra people favoured ADC and its candidate, Chief Akachukwu Nwankpo, by electing the ADC, the state would enjoy the best leadership since its creation. The Anambra State governorship election is billed for November 6, 2021.

BREAKING: Sunday Igboho cannot be extradited, says lawyer

Lawyer to Yoruba Nation Agitator Sunday Adeyemo aka Sunday Igboho, Chief Yomi Aliu (SAN) has argued why his client cannot be extradited to Nigeria. Confirming Igboho’s arrest on Monday night with his wife, Ropo Adeyemo in Cotonou, Benin Republic, Aliu however stated they cannot be extradited because of a treaty with Benin on political offenders. Declaring Igboho as a political offender, the legal practitioner said the treaty is categorical that any political offender unlikely to get justice at home should not be extradited to home country. He added that lawyers in Benin Republic would be engaged to defend Igboho’s rights against extradition. Aliu, in a statement, said: “It is a shocking news that Nigerian Government has gotten Chief Sunday Adeyemo a.k.a Sunday Igboho Oosa arrested by INTERPOL in Republic of Benin notwithstanding the political nature of his offense and what the DSS earlier said that they refrained from arresting him so as not to overheat the polity of Southwestern Nigeria. “The Extradition Treaty of 1984 between Togo, Nigeria, Ghana and Republic of Benin excluded political fugitives. It also states that where the fugitive will not get justice because of discrimination and/or undue delay in prosecution the host country should not release the fugitive. “Now, Article 20 of African Charter on Human and Peoples Rights to which the four countries are signatories made agitation for self-determination a fundamental right to be protected by all countries. This made Chief Sunday Adeyemo a POLITICAL OFFENDER who cannot be deported and/or extradited by the good people of the Republic of Benin for any reason. “Secondly, that he cannot get Justice or even be killed is apparent in how those arrested in his house were detained for more than 21days now without access to their lawyers. Even the wife among them could not change her undies for 21days! Which inhuman treatment can be more this? “Again another wife of our client Mrs. Ropo Adeyemo, a German citizen, has been arrested together with her husband in Cotonou. What offence has she committed to warrant this? “We urge the good government of the Republic of Benin and international community, especially Germany, to rise up and curb the impunity of the Nigerian Government by refusing any application for extradition of our Client who already has application before ICC duly acknowledged.”

Ex-INEC chief: arrest of Igboho, Nnamdi Kanu won’t end agitations

A former National Commissioner with the Independent National Electoral Commission (INEC), , has argued that the arrest of Yoruba Nation agitator Sunday Igboho and leader of Indigenous Peoples of Biafra (IPOB) Nnamdi Kanu won’t end agitations. The Professor of Sociology at the University of Lagos, Lai Olurode advised the government to further engage their groups and followers on how to douse tension. He said Igboho, who was arrested in Cotonou airport on his way to Germany on Monday night, should have turned himself in the moment he was declared wanted by the Department of State Security (DSS). Olurode, who spoke with reporters after Eid-el-Kabir prayer at The WING School, Iwo, Osun State on Tuesday, said Igboho shouldn’t have tried to escape arrest. He said: “I don’t think individuals should challenge state institutions. How I wished Igboho didn’t allow himself to be arrested, I wished he had submitted himself to authorities when he was declared wanted. “Of course, there will be legal representation for him but it going to be an ordeal for him. I hope he will not be maltreated.” On how the Federal Government should handle Igboho, he said: “The way the FG handles Igboho’s case will portray the state either in a good manner or bad. Now that he is arrested, the state has demonstrated his formidability as an institution. “I will only caution that he should be treated with respect and access to legal representation. He should be accorded the right as a citizen of Nigeria. The state should be magnanimous enough to show the world that this is a decent country. “Arrest of Igboho and Kanu will not end the agitation. FG should reach out to the groups of Sunday Igboho and Nnamdi Kanu to discuss on way forward. “Those two individuals are just mere representatives of worries and concerns. The State should not be seen by relating with some set with sticks while others with carrots.” He added: “The State should demonstrate that there is no untouchable in the country. People believe that some people who are so drastic and draconian are been treated with glove hands. “The State should communicate in equivocal statements to committed in uphold law and order. That civil institution should be the way to go to resolving the crisis of development that we are confronted with.”

UK asks FG to explain circumstances of Nnamdi Kanu’s arrest

BREAKING: Court refuses to sack Gov Uzodinma, Deputy

A Federal High Court in Abuja has dismissed a suit seeking to nullify the election of Hope Uzodinma and his Deputy Prof Placid Njoku and declare the governorship seat of Imo State vacant, The Nation is reporting. Justice Taiwo Taiwo held on Monday, July 19, that the applicant, Mcfyne C. Chikwedu, had no locus standi, adding that the suit was “patently non-justiciable.” The judge noted that Uzodinma’s election had been affirmed by the Supreme Court and his court was not an election tribunal that could sit on appeal over elections conducted by the Independent National Electoral Commission (INEC). He ordered Chikwedu to pay INEC N250,000 as costs “for bringing such a frivolous and meaningless suit to this court for adjudication.” INEC and the Attorney-General of The Federation (AGF) were the first and second defendants, marked FHC/ABJ/CS/1085/2020. The judgment followed Chikwedu’s suit alleging the Governor did not meet the constitutional requirement to be declared winner of the March 9 gubernatorial election of Imo State. But dismissing his contention, the judge observed that there was no connection between the plaintiff and the defendants jointly or severally. Taiwo held: “If I may ask, was he (Chikwedu) a contestant in the Imo Governorship Election in 2019? He only described himself in paragraphs 1 and 2 of the affidavit in support of the originating summons thus: ‘(1) That I am the plaintiff in this suit and an indigene of Ikeduru LGA of Imo State. (2) That by virtue of my position I am conversant with the facts of this case.’ “These averments are not enough to cloth the plaintiff with the toga of locus standi. “It is a notorious fact that the issue of the Imo State governorship election has been litigated up to the Supreme Court; the Apex Court in the land on the 14th of January, 2020 and it was held among other things that Senator Hope Uzodinma is the winner of the Governorship Election of Imo State and that the Certificate of Returns be issued to him. “This court cannot shut its eyes to these facts…This case has no legs to stand on. It is dead on arrival and nothing can be done to resuscitate it. I need to state that cases of this nature ought not to be permitted to see the light of day if not for the constitutional provision as to fair hearing. “I am of the well-considered view that parties should desist from bringing such time-wasting suits to court knowing fully well that they have no chance to succeed. The time of the court is very precious. “This case is dismissed in its entirety. This is the judgment of the court.” The applicant had sought a declaration that Uzodinma’s election as Imo governor was unconstitutional and illegal for violating Section 1 and 179 of the 1999 Constitution. He also sought, through his counsel F. I Aliuna, an order compelling INEC to withdraw Uzodinma’s Certificate of Return and conduct a fresh gubernatorial election in Imo State within 90 days from the date of the nullification. Furthermore, he prayed for an order dissolving the Imo State Executive Council, Imo State Boards and Commissions, Imo State Local Government Interim Management Committee as constituted and all other appointments so far made by the Governor, and his Deputy and to direct them to immediately handover to the Speaker of the Imo State House of Assembly. Lastly, he prayed the court to direct the Chief Judge of Imo State to swear in the Speaker of the Imo State House of Assembly as the Acting Governor with immediate effect pending the election and swearing-in of a substantive Governor. INEC opposed him via his counsel, Anthony Onyeri, on the ground among others of a lack of locus standi, while the AGF did not enter an appearance. Upholding INEC’s preliminary objection, the judge dismissed Chikwedu’s suit “in its entirety.”
