Seized 25 trucks: A/Court dismisses Evans’ N200m suit against police

The Court of Appeal Lagos division on Thursday dismissed an appeal by alleged kidnap kingpin Chukwudumeme Onwuamadike, aka Evans, challenging the seizure of his 25 trucks by the police. A three-man panel of the court, in a unanimous decision, upheld the judgment of Justice Hadizat Rabiu-Shagari of the Federal High Court on the matter. The panel held that the appeal lacked merit and dismissed the same. The justices upheld the police’s contention that the trucks were seized as suspected proceeds of crime in the execution of a valid search warrant. Justice Joseph Ikyegh, in the lead judgment, held the warrant was issued and executed in line with section 144 of the Administration of Criminal Justice Act of Nigeria, 2015 empowering the Police to recover the trucks. He noted that section 153 of the Administration of Criminal Justice Act of Nigeria 2015, permits the Police to retain proceeds of crime until the case is disposed of. The judge also held that the Sections were in line with section 44(1)(k) of the 1999 Constitution which permits the temporary seizure of property for Investigation or restitution. Justice Ikyegh also held that since the trial is pending, the word ‘Confiscate’ as used by Evans’ Counsel was not appropriate in the circumstance. He upheld the decision of Justice Rabiu-Shagari of Federal High Court and dismissed Evans’ appeal for lacking in merit. Other members of the panel, Justice Abubakar Sadiq Umar and Justice Onyekachi Aja Otisi, agreed with the lead judgment. Evans through his counsel, Mr Olukoya Ogungbeje, in a suit marked FHC/L/CS/1515/17, had accused the Inspector-General of Police and four others of unlawfully seizing his 25 trucks and converting same to their own. Other respondents are the Nigeria Police Force (NPF), Inspector-General of Police Response Team (IRT), Lagos State Commissioner of Police, and Special Anti-Robbery Squad (SARS). Evans had alleged that the said trucks were seized from him without a court order, saying that the police forcibly confiscated the trucks from him on June 15, 2017, without any court order. He asked the court to award N200million as general and exemplary damages against the police for the alleged violation of his rights under sections 36, 43, and 44 of the 1999 Constitution. But the police, through its counsel Emmanuel Eze, attached to the State CID, Panti, Yaba, Lagos, prayed the court to dismiss the suit as the trucks were proceeds of crime and were exhibits. The police in a counter-affidavit deposed to by Inspector Haruna Idowu said the suspect acquired 11 trucks with proceeds of crime, adding that 10 of them were recovered by the police. He said the trucks were listed as exhibits in the charges filed against Evans at the Lagos State High Court. “The applicant is the notorious and most dreaded armed robber and kidnapper known as Evans, who defiled police arrest for over 10 years and who had terrorised many states of Nigeria with his various gang members. “The applicant has no other source of livelihood except armed robbery and kidnapping as so many arms and ammunition were recovered from the applicant during his arrest. “The applicant had purchased various properties with proceeds of armed robbery and kidnapping. He purchased 11 trucks with proceeds of crime. “The police recovered 10 in Lagos while they were not able to tow the remaining one from Anambra State to Lagos because the applicant’s brother-in-law, Mr Okwuchukwu Obiechina, and his wife had tampered with the brain box of the truck in a bid to pervert the course of justice”. Justice Rabiu-Shagari on April 19, 2019, dismissed Evans’ suit for lacking in merit. Dissatisfied, Evans through his lawyer, Ogungbeje, approached Appeal Court in an appeal numbered CA/L/1105/2018. Mr Eze also filed a counter to the appeal and prayed the court to dismiss the appeal.

Abba Kyari should be handed over to FBI — Northern group makes U-Turn

Coalition of Northern Groups (CNG) has said the embattled Deputy Superintendent of Police (DSP), Abba Kyari, who was indicted of complicity in a fraud investigation should be handed over to Federal Bureau of Investigation (FBI). The group’s spokesperson, Abdul-Azeez Suleiman was recently caught on leaked tape seeking the suspended DCP’s extradition. Recall CNG and other groups in the North earlier rose in defence of Abba Kyari. At a meeting in Kaduna, the Northern groups demanded a review of Kyari’s suspension and immediate transfer of his case to the Nigeria Intelligence Agency (NIA). However, Suleiman on a leaked tape extracted by Vanguard, said Abba Kyari should go to United States to prove his innocence, saying all the noises from some quarters wouldn’t stop the US to try the embattled police chief.

Notorious Boko Haram Commander Surrenders

A top Boko Haram insurgent, (Amir) Senior Commander, and his family have surrendered to troops of Operation Hadin Kai in Gwoza Local Government Area of Borno State. Daily Trust gathered that Amir Adamu Rugu Rugu was known for deadly activities against troops and commuters around Mandara hill and Sambisa forest in Gwoza area. A top security source confirmed that Amir Adamu surrendered alongside three wives and children in Gwoza town. A resident of Gwoza told our correspondent that the surrendered terrorist is well known in the town. “All Praise be to Almighty Allah, the famous Boko Haram, Amir Adamu Rugu Rugu surrendered in today in Gwoza town. Karshen BH yazo insha Allah,” he said. Nigeria military had claimed that exodus surrender was as a result of sustained land and air bombardments of their enclaves and hideouts in the North East.

Five feared dead in Taraba boat mishap

Five persons are feared dead in a boat mishap on Tuesday in Mareniyo, Ardo-Kola Local government area of Taraba State, the police have said. One of the victims is a clergy with the Christian Reformed Church in Nations (CRCN), Shedrack Bako, according to a member of the church. The boat, with 14 persons onboard, left Mareniyo on Tuesday for a village in Karim Lamido Local Government Area of the state when it capsized in the middle of the water. A source said the boat was conveying passengers and goods when It capsized. The source could not ascertain the cause of the accident but assumed that water wave was hard on the boat, which he said is the common cause of such disasters. BREAKING: Shagari’s Widow Dies Of COVID In Abuja Hospital

The widow of former President Shehu Shagari has died from COVID-19 complications. She was said to have died at a hospital in Abuja on Thursday. In a statement signed on behalf of the family by the Sarkin Marafan Shagari, Muhammad Bala Shagari (retd Capt.), announced Hadiza’s demise. “We regret to announce the demise of our beloved mother, Hajiya Hadiza Shehu Shagari, the wife of H.E late President Shehu Usman Aliyu Shagari, GCFR (Turakin Sokoto).” “We lost her in the early hours of today, 12th August 2021, at about 3:00 am, after battling Covid-19 at the Gwagwalada Isolation Center in Abuja.” The statement said the deceased aged 80 would be buried on Thursday evening. “Hajiya Hadiza Shehu Shagari was 80 years old. Her Jana’iza (Funeral Prayer) will take place today, at 4:00pm, immediately after Asr prayer, at the National Mosque, Abuja,” the statement read.

we are the victims of its reverberations, but when we wear the jackboots and are handing down orders, censures; singling shots, cutting down, attacking and destroying other people we palliate our actions. In most cases, we subsume our venture in tyranny as ‘’activism’’ – a term that has now become nebulous and an umbrella for highwaymen clutching the banner of civil advocacy. There is a dictator in every Nigerian. We want to be heard, but we do not want to hear others. Even when we listen, it is not to understand but to muster ammunition for a belligerent response. The falcon does not hear the falconer. We have become so regimented in our cerebration that any view which does not follow a ‘’popular solitary narrative’’ is blitzed, and the messenger assailed ruthlessly. It must be our way or the highway to hell. A straitjacket opinion dominates the landscape and all contrary perspectives sentenced to silence. If you dare to think different or say different, you are cancelled, ridiculed, vilified and slandered. In our world, everyone must be on the bandwagon of the solitary narrative. Is this not a tyranny of opinion? Are we not dictators? I have become a staple for vicious internet hobgoblins. These imps find my unyielding stance on national issues vexatious. To them, it is uncharacteristic for someone from the south-east to speak in defence of Nigeria or take a position away from the prevailing socio-political doctrine. Their run-off-the-mill argument is that since I am Igbo, I must defend the Igbo – whether for good or for evil. But I cannot fit into that provincial receptacle. It is not me. My calling is for humanity regardless of tribe, religion or political persuasion. When it is time to take a righteous stand for any group whether – Igbo, Hausa, Yoruba, Fulani, Igala, Ibibio, or Ijaw – I will proudly do so. What affects one afflicts all of us. Native mentation. This is our challenge — to see in tribal silos and do not to think beyond the tribe. We must evolve beyond this drawback. Armies of Nigerians from different sections of the country must rise up and defend Nigeria and Nigerians. We should not always retreat into ethnic shells and interpret national matters by sectional prejudice. We must stand in the beautiful middle dividing nonsenses. My stint in activism enriched my knowledge of civil advocacies – and their ugly underbelly. The clouds are not always white and robins do not always sing. The Nigerian civil society space is one that is tainted and blackened by ego, rapaciousness, and sleaze. I participated in some advocacies in the past with a mind brimming with passion for Nigeria and a fist raised for a change in my country. I was naïve. My dispassionate commitment to certain causes and conviction led me down the primrose path of deception. In my innocence, I assumed everyone raising a fist and parroting slogans had genuine intentions. It was devastating for me when I realised some of these advocacies are well-oiled campaigns promoted by unclean characters. Most civil advocacies do not sprout organically. There is always a mighty hand behind the curtains pulling the marionettes. There is also the all-knowing complex with the activism industry. ‘’Activists’’ appear to have the right prescriptions to Nigeria’s problems as well as the Midas touch to turn things around. They make pleasing noises; shout the loudest in the room, deliver wry but perfect one-liners, and seal every oration with powerful quotes from famous persons — all by rote. They know what to say in every situation. But many of these advocates from the Nigerian ‘’activism community’’ found themselves in government and became what they stood against in their days in the trenches – and instead of bringing change, they caused government to atrophy with a Sadim touch. A once vibrant activist with a mouth full of hot words revealed his true plumage and betrayed his hypocrisy when he became state governor and then national chairman of a major political party. There are many like that in the activism community waiting for their turn at the table. And while they are waiting they must keep shouting until their mouth is fed. While the ‘’activism community’’ claims to be at war with tyranny, it does not brook opposition. Members who do a volte-face or have a change of perspective are ‘’de-comraded’’ or dismissed as ‘’compromised’’. There is a dictatorship of opinion in the activism community. It must be ‘’attack, tear down, criticise and pull down’’. If you happen to point out the flickers of hope in the system, you are reduced to a quisling. This does not obviate the place of genuine activists – those whose singular pursuit is to see a better Nigeria. Even in a crate of rotten eggs, we still have the unsoiled ones. There is a dictator in every Nigerian. We hold those in government to scrutiny for alleged acts of tyranny while ignoring our complicity. We should hear one another. If you insist only your way must stand, how are you different from Idi Amin? Dictatorship stirs resistance. When you come to people from a position of tyranny, naturally they will resist you. This is a normal human reaction. No one wants to be dictated to, no one wants to be pushed around or made to feel like an indentured slave. We should hear one another. Missing Islamic Cleric Found Dead In Ogun

A prominent Islamic cleric and Chief Imam of Atiba community in Ijebu-Ode, Ogun State, Sheikh Mushafau Bakare, has been found dead. Sheikh Mushafau was reportedly abducted by unknown gunmen on Wednesday night. However, he was found dead inside his newly acquired Toyota highlander in the early hours of Thursday, around Ikangba area in Odogbolu local government area of the state. The Ogun state police were quick to dismiss any reports of kidnap and assassination of the late chief Imam. Speaking on Thursday, the Police public relations officer, DSP, Abimbola Oyeyemi said that the Sheikh may have died of hypertension as a family source revealed the autopsy conducted on him revealed no trace of violence on him. DSP Abimbola also stated that the body of the late Islamic cleric was found in his car by police officers from Obalende area of Ijebuode while on a routine patrol around where his car and body was found. He assured that the police has commenced investigation on the sudden and unnatural death to unravel the circumstance leading to his death. It was gathered that a search party was conducted when the Cleric said to be in his 60s was declared missing by his children, and Muslim faithful in the town. The search proved futile. The cleric was said to have been buried according to Islamic rites.

He said this to his Deputy Head of House on Thursday, day 19 of the show, as they both lay on the bed in the Head of House lounge. Pere told Maria that he had a dream about them having six kids in four years time but Maria questioned him about how he got to remember his dreams. The 36-year-old HoH answered, “I couldn’t remember fragments of the dream. It wasn’t until I got in front of the Diary room door that I now remembered everything. “Don’t you sleep and wake up and then you can’t remember some parts of the dreams that you had?” Maria asked him to narrate the dream and he said, “I told you we had six kids.” “You and I had six children?” She asked him twice in disbelief. He answered, “I swear. Six. Two sets of twins and then one set of twins.” Then Maria said, “Good for you and the twins. Just don’t get me involved.” Maria has been Pere’s love interest in the house since they were both revealed as the Wildcards of the season. She had told him to his face that she didn’t like him and since then, he claimed that he was no longer interested in her. However, fans of the show has named them ‘Peria’ which is coined from a combination of both names. When Pere became Head of House on Monday, it was not surprising that he chose Maria as his deputy.

FG rules out another lockdown

The Federal Government ob Thursday assured that despite the presence of the Delta variant of coronavirus in the country, it is not at a level where another national shutdown will be considered. Minister of Health, Dr. Osagie Ehanire, stated this while speaking at the weekly ministerial press briefing organised by the Presidential Communications Team at the Presidential Villa, Abuja. Ehinare also revealed that apart from the vaccines sourced free of charge, Nigeria has paid for about 30 million doses of Johnson and Johnson doses. ‌ According to him, since the prices of the one-shot vaccine had dropped, the country hopes to purchase about 40 million doses of the vaccines in all. Ehanire said the 176,000 doses of the Johnson and Johnson doses had already been received while the remainder will come in batches. He assured that the majority of vaccines used in the country would be bought by government rather than depending on those gifted to it by other countries. The Director General of the Nigeria Centre for Disease Control (NCDC), Dr. Chikwe Ihekweazu, noted that the cases of COVID-19 recently sequenced in Nigeria are Delta variant, which he said had made it the dominant variant in the country. Also speaking, the Executive Director of the National Primary Health Care Development Agency (NPHCDA) Dr. Faisal Shuaib, said 2.3 per cent of eligible Nigerians had been vaccinated.

EXTRA: Nnamdi Kanu will be free in 2022

The leader of the proscribed indigenous people of Biafra (IPOB) would be free by December 2021, according to Prophet Odumeje, whose real name is Chukwuemeka Ohanaemere. During a taped prayer session, the cleric made the prophecy. Kanu’s lawyer, Ifeanyi Ejiofor, and others were in attendance. Odumeje said: “Lord, your son Nnamdi Kanu is coming out this December, in the name of Jesus. “There is nothing you said that will never come to pass. Lord, we have started this battle with your name, and we shall overcome with your name. “Your son (Ejiofor) in the front of the battle, be with him always. Give them strength, give them wisdom. This is a battle of wisdom and the wisdom comes from you. “In the presence of the judge, everything that comes out of his (Ejiofor’s) mouth shall be wisdom. Victory shall be given to us.” The Mountain of Holy Ghost Intervention and Deliverance Ministry in Anambra has Odumeje as its General Overseer. Kanu, the leader of the Indigenous People of Biafra (IPOB), is accused of treason for actions against the state. After years on the run, the secessionist was apprehended outside Nigeria and repatriated on June 27. In October, Kanu’s trial at the Federal High Court in Abuja will resume. He is being held at a facility run by the Department of State Services (DSS). The motion for transfer to Kuje Prison by his legal team had been denied by Justice Binta Nyako. Security agencies anticipate Kanu’s supporters will attack the detention center in order to liberate him.
