SERAP Sues Buhari Govt To ECOWAS Court Over ‘Secrecy In Spending Of Loans, Debt Crisis

Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against the government of President Muhammadu Buhari over the alleged “secrecy in the spending of loans so far obtained, the unsustainable level of borrowing by the government and the 36 states, debt crisis, and the disproportionately negative impact of these retrogressive measures on poor Nigerians.” In the suit filed last week before the ECOWAS Court of Justice in Abuja, SERAP sought: “An order directing and compelling the Federal Government to issue an immediate moratorium on borrowing by itself, and the 36 states, in conformity with the country’s international human rights obligations.” SERAP also sought: “an order directing and compelling the Federal Government to publish details of spending of the loans obtained by governments since 1999 including the list of projects and locations of any such projects on which these loans have been spent.” In the suit filed by SERAP on behalf of concerned Nigerians, the organisation contended that: “Persistent and unsustainable borrowing by the federal and state governments and the crippling debt burden undermine the rights of Nigerians to economic and social development, and are antithetical to the public interest.” SERAP is arguing that “The crippling debt burden is a human rights issue within the jurisdiction of the ECOWAS Court because when the entire country is burdened by unsustainable debts, there will be little money left to ensure access of poor and vulnerable Nigerians to legally enforceable socio-economic rights.” SERAP is also arguing that “there is lack of transparency and accountability in the spending of the loans so far obtained, and opacity around the terms and conditions in loan agreements, including repayment details for these loans. The details of the projects on which the loans are spent are shrouded in secrecy.” SERAP is also seeking “an order directing and compelling the Federal Government to conduct an assessment of the borrowing by governments since 1999 to address the dire consequences of unsustainable debts on people and communities and to ensure that borrowing at all levels of government considers the human rights impacts.” In the suit filed by SERAP lawyers Kolawole Oluwadare and Opeyemi Owolabi, the organisation contends that “Long-term unsustainable debt can be a barrier to the government’s ability to mobilize resources for human rights, and may lead to taxes and user fees that impact negatively on vulnerable and marginalised Nigerians.” The suit, read in part: “If not addressed, the escalating borrowing and looming debt crisis would cripple the ability of both the Federal Government and the 36 states to deliver ensure basic socio-economic rights, such as quality healthcare, education, and clean water of the most vulnerable and marginalized sectors of the population.” “Without a moratorium on borrowing, the Federal Government and many of the 36 states may be caught in a process-driven mostly by creditors’ needs. This will result in an exorbitant social cost for the marginalized and vulnerable sectors of the population.” “The ability of the Nigerian government to ensure human rights is inextricably related to the ability to spend needed resources. Growing debt burdens and debt repayment difficulties will have negative impacts on the ability of the Defendant to fulfill the basic socio-economic rights of poor and vulnerable Nigerians.” “Sustainable debt management by the Federal Government and state governments will contribute to mobilizing resources for human rights and essential public services, and promote a culture of responsible borrowing.” “The Federal Government and many of the 36 states would seem to be in debt distress or at high risk of debt distress. According to reports, the Senate and House of Representatives recently approved the loans of $5,803,364,553.50 and a grant component of $10m under the 2018-2020 External Borrowing (Rolling) Plan of the Federal Government.” “This followed previous approvals by the National Assembly of $16.2 (16,230,077,718) billion loan; €1 (1,020,000,000) million and a grant component of $125 million loan; $36.8 billion, €910 million loans, and a grant component of $10 million; $8.3 billion and €490 million loans; $6.1 billion, $1.5 billion and 995 million loans; and $4(4,054,476,863), €710 million and grant component of $125 million.” “Several of the 36 states are also facing a debt crisis, and vicious debt cycles. According to the Debt Management Office, the foreign debt stock of the Federal Government, 36 state governments and the Federal Capital Territory presently stands at $37.9bn.” “The loans from China alone amount to $3.59bn. According to the UN Independent Expert on foreign debt and human rights, Nigeria faces debt service relative to tax revenues that exceed 20 per cent, with escalating social tensions linked to poverty and inequality.” “According to the World Bank’s IDA FY21 Report, with debt exposure of $11.7 Billion US Dollars, Nigeria ranked fifth among the top 10 countries with highest debt risk exposure. The top four countries are India with $22 billion, Bangladesh ($18.1 Billion), Pakistan ($16.4 Billion), and Vietnam ($14.1 Billion).” “While it is critical for the Federal Government and state governments to have adequate resources to fund their budgets, it is equally critical for governments to give consideration to the human rights impact of borrowing. Persistent borrowing is inconsistent with the country’s human rights obligations.” SERAP is also asking the ECOWAS Court for the following reliefs: A declaration that the failure of the Defendant to halt the persistent and unsustainable borrowing amounts to a breach of the Plaintiff’s and other Nigerians’ rights to the enjoyment of socio-economic rights, and development, as guaranteed under articles 2, 9, 11, 12 and 13 of the International Covenant on Economic, Social and Cultural Rights, and articles 2, 15, 16, 17, 22 and 24 of the African Charter on Human and Peoples’ Rights. A declaration that the failure of the Defendant to halt the persistent and unsustainable borrowing amounts to a fundamental breach of Nigeria’s human rights obligations under the International Covenant on Economic, Social and Cultural Rights, and the African Charter on Human and Peoples’ Rights. Abdulsalami: I Asked Obasanjo Not To Go Into Politics

Former Head of State, General Abdulsalami Abubakar (rtd), has revealed how he advised former President Olusegun Obasanjo against joining politics shortly after he was freed from detention. Obasanjo, who was detained by the regime of late General Sani Abacha, regained freedom when Abdulsalami took over power. Abdulsalami subsequently handed over power to Obasanjo who was elected president in 1999. After this, some critics accused Abdulsalami of imposing Obasanjo, a retired general and former Head of State, on Nigeria. But in an interview with Trust TV, Abdulsalami dismissed such thought, narrating how Obasanjo visited him shortly after his release and sought his advice on going into politics. The Chairman of the National Peace Committee said he advised Obasanjo to disregard the people, rather go home and sort out his health. He insisted that he had nothing to do with Obasanjo’s participation in the poll that brought him to power in 1999. “He (Obasanjo) came to see me to tell me that he had been approached by this group of people, they want to make him the candidate to stand for election.” “I said “Sir, if I were you, please disregard this people, Sir, go home and rest and sort your health out and so on and so forth”. He said “Okay, General thank you for your advice, I will get back to you”. He never got back to me. The next I hear was that he was one of the presidential candidates. “I tried to tell people that I had nothing to do in bringing Obasanjo to contest the election. Whatever must have happened was within the political parties and so on.” When asked whether he ‘rehabilitated’ Obasanjo to allow him contest in the election, he responded “Like I had all other prisoners! What do you mean by I had to rehabilitate him? “Well I am thinking of his businesses, whether he was helped with something to revive them which was one of his complaints. “Of course not only him, all people that were imprisoned in one way or the other, we tried to rehabilitate them; to help them in one way or the other. In one way or the other we did what we could to assist them, so you cannot equate that to bringing him to contest for an election.”

“Politics will never retire from your blood’ — PDP chairman replies Obasanjo

Iyorchia Ayu, national chairman of the Peoples Democratic Party (PDP), says politics will always be part of former President Olusegun Obasanjo. Addressing the former president on Saturday when he led PDP leaders to visit him at his residence in Abeokuta, Ogun state, Ayu said “partisan politics will never retire from your blood”. The PDP chairman made the comment in response to Obasanjo who had earlier said nothing can make him return to politics. “Though you retired from partisan politics, partisan politics will never retire from your blood,” Ayu said. “You always want the right thing done and since you want the right thing done, for life, you will remain the emeritus member of the PDP. “You cannot build a house and leave it to collapse. “We will continue to contribute our own quotas to the growth of the party and the nation and we will continue to come to you. “So, I want to plead with you, please don’t be tired of us as we come knocking, asking for your advice and wisdom because the words of elders are the words of wisdom.” Ayu said it was appropriate to visit Obasanjo with the party chieftains to learn from his wealth of experience. The PDP chairman said Obasanjo’s tenure as Nigeria’s president was a golden era. He said: “During that period, not only did you grow Nigeria’s economy to be the biggest in Africa, you were able to take the country away from slavery by negotiating and cancelling so much of its foreign debts. “The direct foreign investment (FDI) in the country was on the increase on daily basis with attendant respect for Nigeria from the international community. “Most of the institutions and agencies set up during your tenure, including the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices and Other Related Offences Commission (ICPC), are still useful in the country. “You are very passionate about this country and you did a lot. So, we thought we should come and thank you for what you have done, not just for Nigerians, but also for our party and the African continent. “I think today, in all modesty, after the departure of late President Nelson Mandela of South Africa, there remains only one person of such stature on the African continent. “We are proud that the person is a Nigerian in the person of former President Olusegun Obasanjo.”

NDLEA arrests six over drug cookies, noodles

The National Drug Law Enforcement Agency, on Sunday, said attempts by drug traffickers to export 1.53 kilograms of cocaine hidden inside hair cream to London, and another 880 grams of cocaine concealed inside synthetic hair to Jeddah, Saudi Arabia, as well as 3 grams of cocaine and 5grms of cannabis to Cyprus, packed inside locally made shoes through two major courier companies in Lagos, have been foiled by narcotic officers attached to the firms. Director, Media and Advocacy, NDLEA Headquarters, Abuja, Femi Babafemi, made this known in a statement. He said in Edo State, operatives on Tuesday, January 18, intercepted a Toyota Camry Car with Reg. No. FKJ 897 DG (LAGOS) loaded with 360.4kg Cannabis sativa heading to Abuja and arrested the driver, Nurudeen Subaru, 42, in Auchi, Etsako West area of the state. “The following day, the Edo Command officers also evacuated 111kg cannabis stored in a bush at Iruekpen, Esan West LGA while 276 compressed blocks of the same substance weighing 248.4kg were recovered from one Austin Okongwu (a.k.a Igwe), 45, at Agenebode, Etsako East while moving the drug in a Lexus saloon car with reg. no. ABC 583 MJ (ABUJA). “Also on Wednesday 19th Jan., a raid on a drug joint in the Edo state capital, Benin, led to the arrest of three drug dealers: Kelly Ogbebor, 38; Daniel Oviawe, 35, and Kelly Kenmakonam, 29 with different quantities of cocaine and heroin seized from them. In Plateau State, attempt by 29-year-old Ifeoma Godwin Sade, wife of a drug dealer, Ifeanyi Onyeasi, 34, to swallow 12grams of cocaine found in their house at Agingi, Rukuba road, Jos, during an arrest operation was scuttled by operatives who retrieved the drug from her throat on Sunday 16th Jan. Also recovered from them was a monetary exhibit of Two Hundred and Thirty Four Thousand Six Hundred and Fifty Naira Only (N234, 650). “Different quantities of cannabis, methamphetamine and tramadol were seized from two suspects; Aliyu Abdullahi and Ishaya Emmanuel, when a commercial bus with reg. number GME711YX bringing them from Lagos to Yola, Adamawa state was intercepted along Abuja road by officers of the Plateau state command on Wednesday 19th Jan. “In Adamawa state, on Wednesday 19th Jan. the long arm of the law eventually caught a notorious drug dealer, Adamu Musa who has been on the run for nine months. His 31-year-old elder sister, Mrs. Hannatu Sini had been arrested on 16th April 2021, at Gombi Local Government Area of Adamawa with 14.400kg of cannabis sativa and admitted keeping the exhibit for her younger brother, Adamu Musa who was subsequently placed on the wanted list of the command. This is even as an ex-convict, Mrs. Modinat Lawal, was arrested in Kano on Wednesday 19th Jan with 22kg cannabis sativa she brought into Nigeria from Benin Republic. She had earlier been arrested, prosecuted and jailed for the same offence. The Ogun state born trafficker claimed then that her name was Bola,” the statement read. Yahaya Bello to Nigerians: I’ll not betray your trust if elected president in 2023

Yahaya Bello, Kogi state governor, has assure Nigerians that he will not betray their trust if elected as the president of the country in 2023. Speaking on Thursday during a north-east state legislators meeting in Bauchi state, Bello said he will not disappoint Nigerians because he always keeps to his promises. The governor, who spoke to the lawmakers on phone, further noted that he is confident that he will achieve victory at the polls and “get to the promise land”. “It is about all of us. It is about our party, about Nigeria and our future. But by the grace of God, with your support and prayers, I know we will get to the promised land,” Bello said. “I would have been there personally to appreciate you, but I don’t want to be seen to be breaking the law by now since open campaigns have not been allowed. I want to keep to the law. “I’ll come around when the ban is lifted to speak to you one-on-one in your various enclaves. However, my speaker and other well-spirited Nigerians are moving around the country and are talking to people of importance, especially critical stakeholders like you. “I want to promise you that I will not disappoint any of you. Looking at the relationship I have with my speaker of the Kogi state house of assembly, I know that by the grace of God when we get to the promised land, we will have a more robust and wonderful relationship when we get to the villa and I know we will get to the villa on May 29, 2023, by the special grace of God. “I need your support. I need your prayers. I need your buy-in. I need you very much so that together, we can save this country and build on the successes of President Muhammadu Buhari. I once again promise that I will not betray your trust. IPOB, Nnamdi Kanu drawing Biafra map, ‘a lie from pit of hell’ — IPOB tells Ijaw group

The Indigenous People of Biafra, IPOB, has dismissed as unfounded and a lie from the pit of hell that it has drawn the map of Biafra, saying the allegation is being sponsored by it’s enemies. The pro-Biafra group also stated that the allegation is false and intended to set Biafrans against themselves saying that the issue of Biafra map should not generate any heat because Biafrans know themselves. A statement by IPOB’s Media and Publicity Secretary, Emma Powerful, entitled Nnamdi Kanu did not draw any map of Biafra, said, ”the Ijaws should stop saying that Ijaw wasn’t conquered pre colonial and Colonial era because Igbo never said they were conquered. Emma Powerful also asked the Ijaw National Council, INC, to understand and remember that their ”brother” Dr Frank Opigo initiated the name Biafra which the whole of Biafrans are known for today. IPOB’s statement read, “We are the global movement and family of the Indigenous People of Biafra IPOB, under the command and leadership of Mazi Nnamdi Kanu. “Our attention has been drawn to the blackmail being sponsored by our detractors that IPOB has drawn the Biafra map. We, therefore, want to debunk such fallacious narrative. We did not draw any Biafra map. “We understand that some people in the coastal region of Biafra are misinformed and deceived with false information that IPOB, Nnamdi Kanu and Igbo have drawn the map of Biafra. “It is false and intended to set us against ourselves. The issue of Biafra map should not generate any heat because we know ourselves. “Ijaw National Council, INC, should understand and remember that their brother Dr Frank Opigo initiated the name Biafra which we answer today. “They should stop saying that Ijaw wasn’t conquered pre colonial and Colonial era because Igbo never said they were conquered. Igbo people never conquered any tribe in the old Eastern region because our fathers saw themselves as one family, and today IPOB and Nnamdi Kanu, have towed the peaceful steps and accommodating spirits of our fathers. According to Emma Powerful, if any tribe undermine us, no problem, they can continue on their own. Being part of BIAFRA will never be by coercion but a voluntary matter through referendum. “Any tribe or ethnic group that doesn’t want to be part of Biafra will never be forced to do so. Such tribes are free to go on their own, but you must conduct referendum for your people to decide their fate on the agitation for Biafra. “We can attest that Igbo people never fought against any tribe in olden days because Igbo believe in (Onyeaghala Nwanne ya and, Ibiri Kamu biri) (live and let live). Again Ijaw tribe and other tribes in the old Eastern region including Mid Western region are Igbo brothers and sisters today, tomorrow and forever. “Igbo are not going to force anybody or tribe to join the fight for Biafra freedom. Let every tribe try what they can to wake up for their freedom because freedom is good and remains the best for all of us. “No tribe in the old Eastern region and Western region should allow themselves to be deceived because Nnamdi Kanu and IPOB did not draw map for Biafra. Instead, we are staking our precious lives for all and it is the sacrifice we ought to pay for the realisation of our freedom and independence. “We are staking all we have for this freedom project, without Igbo tribe being in forefront of this struggle the struggle would have been a thing of the past and we must continue until freedom is totally achieved. “Again, we appreciate the move by Izon tribe and other tribes in the region to achieve freedom but they should not look by the side because if they do, they will lose their focus then the freedom will move out of their hands, let them focus and work with Igbo tribe because they will go far doing that.

Ibe Pascal Arogorn, Owerri Imo Police Command has killed suspected member of Indigenous People of Biafra IPOB and Eastern Security Network (ESN) during a gun battle in a forest at Onicha in Ezinihitte Mbaise Local Government Area. The command spokesman, CSP Michael Abattam said on Saturday that the police operatives, having carried diligent surveillance of the criminal hideouts , on 18/1/2022 at about 1300 hours, stormed the deadly terror camp. On sighting the operatives, he said the hoodlums opened fire on them but the gallant police operatives swiftly returned tand in the process one of them was neutralised while others escaped with bullet wounds. The statement reads in part: “Following a credible information that, some members of the proscribed IPOB/ ESN terror group, its militia wing has made a forest at Onicha in Ezinihitte Mbaise LGA of Imo State, their operational base where they go out to perpetrate heinous crimes which includes terrorism, kidnapping, armed robbery and killing of innocent citizens . “Based on this information, the ever combat ready Imo Command’s tactical teams, having carried diligent surveillance of the criminal hideouts , on 18/1/2022 at about 1300 hours , stormed the deadly terror camp. ” The hoodlums on sighting the police operatives open fire on them. The gallant and battle ready Police operatives swiftly returned the fire. In the fierce gun battle, one of the hoodlums was neutralised while others scampered into the adjoining bushes fatally injured with gunshot injuries.” He said items recovered on combing the bush and searching the terror camp include one AK47 rifle with 40 rounds of live ammunition, 10 locally fabricated explosives devices, One Police hand grenade, Two Toyota Highlander (SUV) Jeeps without registration numbers, One Lexus 350 SUV without registration number, One Lexus 330 SUV without registration number, two Biafran flags, different assorted charms, and assorted dresses suspected to belong to kidnapped/robbed victims.

I don’t want Sunday Igboho to be released —Evicted Seriki Fulani

Abdulkadri Saliu, the now-ejected Seriki Fulani of Igangan in the Ibarapa North-West Local Council Development Area of Oyo State, says he does not support the calls for the release of embattled Yoruba Nation agitator, Sunday Adeyemo aka Sunday Igboho. Igboho, who has been in a prison in Benin Republic for over six months, had stormed Igangan in January 2021 and warned the herders said to be perpetrating crimes in the town to desist from the alleged acts. He had subsequently issued an ultimatum for Saliu and his men to vacate the town. The evicted Sarkin Fulani had relocated to Ilorin since the incident said his only consolation was the fact that he was not killed on the day he was displaced from the agrarian community. Speaking on the January 22, 2021 incident, he said anytime he remembers the day, he always bursts into tears even as he maintained his innocence over the incidents of kidnapping and killings in the community. “It is on record that only three Yoruba persons were kidnapped in Igangan since the problem started; others were Fulani. “I lost my younger brother in the process. We lost several of my kinsmen. You cannot even count the number of cows that were rustled. It was a sad moment for me. I lost everything I laboured for all my life and life has been extremely hard since last year when Sunday Igboho stormed my settlement,” Daily Trust quoted him as saying. Speaking on the earlier quit notice issued by Igboho prior to his eviction, Sarki explained that he did not handle the eviction notice with levity and he got assurance from the state government after the quit notice but he was surprised that Igboho carried out his threat without anybody challenging him. He said, “For those seven days, the state government sent 14 police officers to us and they were guiding us but the police officers were overpowered by Sunday Igboho’s men. This is why I don’t support the call for the release of Igboho. “I am sure he must be regretting his actions now. Any Nigerian can live in any part of the country and I have always said that there are criminals everywhere. There are criminals among Yoruba just like we have among the Fulani people. This is where we expected the government to come in and fish out those who are criminally minded.” Saliu said one year later, he still hoped that justice would be done and he would be compensated for the properties lost during the crisis.

Boko Haram Terrorists Raze Church, Abduct 15 Girls Near Chibok

A church has been razed and 15 girls abducted by Boko Haram terrorists in a village near Chibok local government of Borno state, following an attack on Thursday night. A local vigilante was also killed during the attack. The name of the village is Pemi, the same area where a Pastor, Bulus Yukura, was kidnapped in December 2020. The assailants targeted the community church EYN NO 1 Pemi. Those abducted were picked from houses around the church; the girls are between the ages of 10 to 13, according to villagers. Chibok local government is located in the southern axis of the State. These attacks have become common in Chibok and environs, with many unreported which security sources attribute to its proximity to the Sambisa forest. Sambisa has been a known base of the outlawed Boko Haram militia, loyal to the late Shekau. Locals say attacks are more frequent during dry seasons as the terrain is more motorable for the insurgents. “The mud during the rainy season impedes their movement which is why we were able to access our farms. But once the rain stops and everywhere becomes dry these attacks are common. We need help.” A local source told Channels Television via telephone. In November the Commanding Officer of the 28 Task Force located in Chibok Brig General Dzarma Zirkushu was killed in an ambush on his way to provide enforcement to troops in distress in the next town. Pockets of attacks have continued ever since, worsening in recent times in villages on the fringes of the dreaded forest.

EXTRA: Bayelsa Gov’t Arrests 44 Cows Over Violation Of Anti-Open Grazing

Bayelsa State task force on the implementation and enforcement of the anti-open grazing law has impounded 44 cows in Yenagoa, the state capital for roaming around the restricted areas. The committee, led by the Bayelsa State Commissioner for Agriculture and Natural Resources, Mr David Alagoa, in the company of security operatives, impounded the cows from the readers. Daily Trust gathered that the herders and owners of the cows were not arrested alongside the cows. Last month, the state’s livestock management committee had charged three herders for violating the state’s anti-open grazing law. Farmers in Bayelsa State have lamented the destruction of their farmlands by cattle, urging the state government to ensure that the anti-open grazing law is totally enforced to avoid conflicts. Recently, some farmers along the Tombia-Amassoma Road axis in Okutukutu community of Yenagoa, while counting their losses due to the destruction of their farms by cattle, said the invasion of their farmlands by herders was affecting their incomes.
