Lawyer: New Charges Against Nnamdi Kanu, Joke Taken Too Far

Barrister Ifeanyi Ejiofor, Nnamdi Kanu’s lawyer, who visited the IPOB leader in DSS detention today, described the fresh 15-count charge the worst abuse ever of court process and a joke taken too far. “Today, we were served with a 15-Count Amended Charge filed by the Director of Public Prosecution of the Federation in respect of a case already scheduled tomorrow, for the hearing of our Preliminary objection challenging the competence of the 7-Count Amended Charge. “This is indeed a joke taken too far as the Federal Government of Nigeria (FGN) is now scouting for an opportunity to truncate tomorrow’s proceeding, knowing fully well that the smokescreen charge is dead on arrival. “We wish to categorically point out with dismay, that this further Amended Charge is the WORST kind of abuse of legal process that we have encountered in the history of legal practice – either in Nigeria or anywhere in the world. “This 15-Count Amended Charge was no doubt brought in bad faith and is aimed at needlessly prolonging proceedings in the cause. The same FGN that brought our Client to Court is needlessly initiating processes that will delay the trial. “It is worthy to note that an Amended 7-Count Charge had earlier been filed against Onyendu Mazi Nnamdi Kanu since October 2021, pursuant to which a preliminary objection was raised against this 7-Count Amended Charge. The parties have fully filed and exchanged processes and arguments on the objection, and the same has been set down for hearing. “Brazenly, a day before the hearing date, and without affording the court the opportunity to listen to arguments on the objection, and take a decision on the objection raised one way or the other, the prosecution, in utter bad faith, filed a further Amended Charge to supercede and supplant the earlier Amended Charge on which issues have been joined on the objection raised against it. This is indeed, the worst kind of abuse of court process. “Although the prosecution has the liberty to amend a charge, it cannot exercise that prerogative to abuse the process of the court, or to supplant an objection that has been raised against an earlier amendment, which has not been decided on, or to overreach the defence, or to render nugatory or as a fait accompli, the decision of the court on a pending preliminary objection against an Amended Charge that is yet to be determined. “Nevertheless, we herein assure UmuChineke that we have already devised a solution to every of their antics, it will only end in court, they can only run thus far. “We therefore, urge you all to await the legal fireworks in court tomorrow. There must be light at the end of the tunnel”. The Federal Government, on Monday, filed the fresh 15-count charge against the detained leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu. The Office of the Attorney-General of the Federation (AGF), in the amended application, filed before a Federal High Court, Abuja, presided over by Justice Binta Nyako, increased the counts from seven to 15. The amended charge marked FHC/ABJ/CR/383/2015 was signed by the Director of Public Prosecution (DPP), M. B. Abubakar. The IPOB leader, who has been facing a seven-count treasonable felony charge, is expected to enter his fresh plea to the 15 counts on Jan. 19 when the matter will come up for hearing. Below is the amended 15-count charges: COUNT ONE That you Nnamdi Kanu, Male, Adult, of Afaranukwu lbeku, Umuahia North Local Government Area of Abia State sometimes in 2021 being a member and the leader of lndigenous People of Biafra, IPOB, a proscribed Organisation, did commit an act in furtherance of an act of Terrorism against the Federal Republic of Nigeria and the People of Nigeria by a making a broadcast received and heard in Nigeria within the jurisdiction of this Honourable Court, with intent to intimidate the population and you threatened that people will die, the whole world will stand still and you thereby committed an offence punishable under Section 1(2)(6) of the Terrorism Prevention Amendment Act. 2013. COUNT TWO That you Nnamdi Kanu, Male, Adult, of Afaranukwu lbeku, Umuahia North Local Government Area of Abia State sometimes in 2021 did commit an act in furtherance of an act of Terrorism against the Federal Republic of Nigeria and the People of Nigeria made a broadcast received and heard in Nigeria within the jurisdiction of this Honourable court, with intent to intimidate the population, you issued a deadly threat that anyone who flouted your sit-at-home order should “write his/her Will” as a result, Banks, Schools, Markets, Shopping Malls, Fuel stations domiciled in the Eastern States of Nigeria were not opened for businesses, citizens and vehicular movements in the Eastern States of Nigeria were grounded within the Jurlsdiction of this Honourable Court and you thereby committed an offence punishable under Section 1(2)(b) of the Terrorism Prevention Ammendment Act. 2013. COUNT THREE That you Nnamdi Kanu, Male, Adult, of Afaranukwu lbeku, Umuahia North Local Govenment Area of Abia State on diverse dates between 2018 and 2021 within the Jurisdiction of this Honourable Court, professed yourself to be a member and leader of the Indigenous People of Biafra, IPOB, a proscribed organisation in Nigeria and that you thereby committed an offence contrary to and punishabie under Section 16 of the Terrorism Prevention Amendment Act. 2013. COUNT FOUR That you Nnamdi Kanu, Male, Adult, of Afaranukwu lbeku, Umuahia North Local Government Area of Abia State on diverse dates between 2018 and 2021 made a broadcast received and heard in Nigeria within the Jurisdiction of this Honourable Court, in furtherance of an Act of Terrorism against the Federal Republic of Nigeria and the people of Nigeria in which you incite members of the public in Nigeria to hunt and kill Nigeria Security personnel and that you thereby committed an offence punishable under Section 1(2)(h) of the Terrorism Prevention Amendment Act, 2013. Terrorists ask Zamfara villagers to pay tax or face attack

Nine communities in Bukkuyum Local Government Area of Zamfara State were asked by bandits to pay a compulsory tax of the sum of N24 million or be attacked. The communities would pay from N500,000 to N5m, according to the bandits. Journalists were told that the communities have started mobilizing to pay the bandits, even as locals said letters to that effect have since reached the affected communities through kidnap victims who regained freedom. A source said the communities were Yangalma, Tungar Gebe, Wawan Iccen Ibrahim, Wawan Iccen Salihu, Galle, Nannarki, Ruwan Kura, Gangara and Gaude. “The bandits have ten days ago, stayed in Gando forest and launched attacks on 7 communities in Bukkuyum and Anka Local Government Areas.” “They killed dozens and rustled over 1,900 cows.” “Some of the community leaders who received letters from the bandits reported the matter to the authorities,” according to a local. However, there was no reaction from official quarters on the development.

Sit-at-home: Amechi threatens to quit negotiation for Kanu’s release

First Republic Minister of Aviation, Chief Mbazulike Amechi, has lamented that the actions of some leaders of the Indigenous People of Biafra are endangering the ongoing discussion and negotiation for the release of the detained leader of the Indigenous People of Biafra, Nnamdi Kanu. This came as masked men suspected to be members of IPOB allegedly enforcing the suspended Monday sit-at-home order attacked traders at Obollo-Afor town in Udenu Local Government Area of Enugu State for disobeying the order on Monday. Amechi had led Igbo leaders to the President Muhammadu Buhari in November 2021 to demand the unconditional release of the IPOB leader. Speaking in a chat with The PUNCH on Monday, he lamented that the sit-at-home order is destroying the South-East economy and also hampering discussions for Kanu’s release. Amechi said, “I discussed with the Presidency and Mr President himself on two subjects – the Igbo situation in Nigeria and Nnamdi Kanu. And our discussion was very good and friendly but the sit-at-home order IPOB is dishing out in the South-East is embarrassing the whole thing. I don’t know the leaders of IPOB and who they are. “Kanu is in detention although the Presidency arranged for me to go and see him and I went and saw him and we discussed. “So, I just told their lawyer, he is in a better position to contact them, to stop the Monday to Thursday sit-at-home. I told him that it is too much and is ruining the economy of the South-East but he told me that they had already issued a statement that IPOB had never said that. “They must stop their actions which make the release of their leader more difficult. If they don’t, I will withdraw my own efforts”, he said.

Police in Nasarawa arrest man over rape of octogenarian

Nasarawa State Police Command said they have arrested a 43-year-old Dan’asabe Eddo for raping an 80-year-old woman in the state. The suspect, who is indigenous to Kubasha Village in Kagarko Local Government Area of Kaduna State, but resides in Kundami Village, Garaku in Kokona Local Government Area of Nasarawa State. He was alleged to have gone into the residence of the octogenarian who stays alone at the same village and forcibly had carnal knowledge of her. According to a statement made available to our correspondent yesterday in Lafia by the Police Public Relations Officer (PPRO) of the command, Ramhan Nansel, an Assistant Superintendent of Police (ASP), said the police operatives attached to Garaku Division immediately swung into action and got the suspect arrested. Upon interrogation, the suspect admitted to the commission of the offence and blamed it on the devil’s handiworks. The Commissioner of Police, CP Adesina Soyemi directed that the case be transferred to State Criminal Investigation Department (SCID), Lafia for profound investigation. He urged members of the public to pay special attention to the elderly and guard them against assaults.

The National leader of the All Progressives Congress, APC, and former Governor of Lagos State, Bola Ahmed Tinubu, has been told to shelve the idea of contesting the 2023 presidential election. Prophet Bisi Olujobi of Wisdom Church International, Ketu, Lagos Nigeria, gave the warning in a statement he signed and made available on Monday. In what he described as a fresh divine insight of what is to be expected in the year 2022/2023, allegedly revealed to him by God, the cleric said he believed that with much prayer the negative part of his prophecies can be averted. The popular octogenarian prophet urged Nigerians and the world at large to be closer to God unlike before, believing this will endear the people more to their creator who has the power to do and undo. Prophet Olujobi revealed that Nigeria will not break as being speculated by a lot of spiritualists and agitators, adding that it is in the mind of God to keep the country together. The clergyman calls for more prayer for Chief Sunday Igboho and the leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu as “they will be released any moment from now” according to what God has shown him, “though it will not be easy, that’s why prayer is needed on their behalf.” On the issue of who to succeed President Buhari, the prophet declared that “Senator Ahmed Tinubu has no chances of becoming the number one citizen of the country but rather, a green light is been seen in the direction of the present Vice President, Yemi Osinbajo and if intense prayer is been rendered, he will eventually become the next President of Nigeria.” Again, the prophet declared that “the nation’s economy and security will not go better than this, as the incumbent president has no will and stamina to do better, rather Nigerians should hope on God, whom their help cometh from.”

Asari Dokubo hired by Nigerian government to kill Biafra agitators-IPOB

The Founder of the Niger Delta People’s Volunteer Force, Asari Dokubo has been accused of working with the federal government to kill Nnamdi Kanu, leader of the Indigenous People of Biafra. IPOB accused Dokubo of also planning with the President Muhammadu Buhari-led government to kill Biafra separatist agitators in the South-East and South-South regions of the country. The group alleged that Dokubo was recruiting cult members to work against IPOB members and other agitators loyal to Nnamdi Kanu. According to IPOB, the youth being recruited by Dokubo are to be paid N150,000 per month. In a statement by its Media and Publicity Secretary, Emma Powerful, on Monday, IPOB said, “We are the global movement and family of the Indigenous People of Biafra under the command and leadership of Mazi Nnamdi Kanu. Quote “We wish to remind Biafrans and the people living in the coastal region of Biafraland which Nigeria falsely called South-South or Niger Delta, that it has come to the knowledge and attention of the global family of IPOB how Asari Dokubo and his co-travellers are recruiting cultists and some deluded and gullible Niger Delta militants to fight against the Biafran cause. “We don’t want to dignify Asari and his criminal recruits with a response but for clarity sake we decided to make this public so that people should not blame us if anything happens. “Biafrans living in both coastal area and hinterland are all part of our great nation. They must understand that Asari and his few traitors are trying to create confusion between Igbo Biafra and Izon Biafra but we are waiting for his recruited boys. He should not think that we are cowards. Let him venture and see what we are capable of doing. “IPOB intelligence unit uncovered plan about how Asari is moving around coastal areas of Biafra land recruiting cultists and demented fellows to join the wicked Nigeria security forces, evil politicians including some governors in the South-East region to attack people and blame it on IPOB and ESN operatives. School certificate too low for public office, says Gbajabiamila

Speaker of the House of Representatives, Femi Gbajabiamila, has stated that there is a need to review the minimum educational requirement for intending officeholders to meet current standards. Gbajabiamila said this on Monday at the 52nd Convocation Lecture of the University of Lagos, where he delivered the Convocation Lecture titled, ‘Building Back Better: Creating a New Framework for Tertiary Education in Nigeria in the 21st Century.’ The Speaker noted that the current requirement for elected public servants only reflected the era it was introduced and not the present in Nigeria. He said, “I also believe that the time has come for us to agree to review section 131 (d) of the 1999 constitution to increase the minimum educational qualification for persons aspiring to political office in Nigeria. “The constitution requires a secondary school certificate or equivalent as the minimum academic qualification for high political office. “This is the requirement for qualification to contest election for Governor, the national assembly, and president. Ladies and gentlemen, this provision is the product of a different time and reflects the reality of that time. “It is time to take another look at that position as part of the ongoing effort to reform our electoral system and establish a fully participatory democracy providing the capable leadership our country needs.” Gbajabiamila stated that the reduction in the age of eligibility for officeholders should be enough reason for an increment in the educational requirement. He added an increase in the educational requirement would help in reforming Nigeria’s electoral system and provide strong leadership for the country. “As we have reduced the age for eligibility to contest those offices so also we should increase the minimum educational requirements. “It will be another step in reforming our electoral system and providing strong leadership for the country. Let us lift our gaze from consideration of small things to focus on the pursuit and achievement of grand ambitions that lift us all and save the future,” he added.

The All Progressives Congress (APC) will set up a zoning committee on Wednesday ahead of its planned convention, TheCable understands. All eyes are on the ruling party on where it would zone its national offices as this may give an indication of what region would produce the presidential candidate. If the chairmanship is zoned to the north, that may be the clearest indication yet that the presidency will go to the south. A source privy to the information said the ruling party is considering February 26 as the date of the convention. TheCable also understands that President Muhammadu Buhari would be briefed after the APC caretaker committee led by Mai Mala Buni, Yobe governor, picks the zoning panel. The convention has generated controversy in the ranks of the ruling party. While many party members — especially APC governors — have insisted that the convention be held soon, other party members such as Orji Uzor Kalu, senate chief whip, have called for it to be postponed to a later month. Kalu had argued that there are issues in the party across the country that need to be addressed before the convention is held. Most of the states that the APC control have completed ward, LGA and state congresses — a prerequisite for the convention. Zamfara, which has party factions, is among the few APC states that have not conducted all the levels of congresses. The party is expected to have a national working committee (NWC) at the end of the convention. Buni has been in charge of the party since June 2020 when the national executive committee (NEC) dissolved the NWC led by Adams Oshiomhole, former APC national chairman.

Tension as 41 year-old man dies in Anambra hotel, organs missing

A 41-year-old, Mr Azubuike Nwokolo aka Zubby More, was found dead in a hotel room in Amichi, Nnewi North of Anambra state with his organs missing. Daily Trust gathered that the father-of-two attended a party in the area on January 13, and decided to lodge at a hotel when it was late for him to go home only to be found dead. One of the deceased friends, Nnaemeka Ikerionwu, who demanded justice for him on social media said he was found dead in a hotel room in Amichi, Anambra State. “He went for a party and when it was late in the night, he couldn’t go home, so he decided to lodge at a hotel in Amichi, Anambra State. He did not return home which got his family members worried,” Ikerionwu said. According to him, after he did not return to his family, they launched a search and discovered that he lodged in the hotel. He said even when the hotel management claimed that he slipped and died they did not contact his family or the police before taking him to the morgue. Ikerionwu said, “It was an unknown person that informed the family that their son was laying in the morgue. The family went to the morgue and found out that his testicles were missing. They confronted the hotel staff and were told that he slipped on the bathroom tiles and died.” He further said that the family suspects foul play as they found wounds on the body of the deceased. According to him, the family and friends are appealing to the Anambra State police command to take up the case and ensure that justice is done. When contacted the state police command’s spokesperson, DSP Toochukwu Ikenga, he said he has no knowledge of such an incident.
