Naira Marley Made Use Of E-tools To Access Compromised Credit Cards – EFCC

  A third prosecution witness in the ongoing trial of Azeez Fashola popularly known as Naira Marley has told Justice Nicholas Oweibo of the Federal High Court sitting in Lagos how electronic tools used for accessing compromised credit card information was found on the laptop of the defendant. The witness, Dein Whyte, who is the Chief Detective Officer and Head of the Cybercrime Section of the Economic and Financial Crimes Commission (EFCC), continued his testimony before the court while being led in evidence by the prosecuting counsel, Rotimi Oyedepo. Whyte said “From my findings, it was clearly established that the defendant through his phone had in his possession credit card details that did not belong to him. That he shared this credit card information with another person and it was also discovered that a fraud report had been generated for the same credit card stating that it had been used fraudulently. ‘Investigation also revealed that the defendant had on his laptop which is registered to him, and recovered from him, electronic tools that are specifically used for accessing compromised credit card information as well as other electronic tools that are used to disguise both the identity and location of anybody accessing compromised credit cards in real time on the internet. Those were my findings”. When he was asked by Oyedepo the role played by him and his team before Exhibit E (the forensic analysis) was produced, he answered saying, “As is procedural in investigation, where recovered digital evidences are of direct importance and value evidentially to a case, the procedure demands of an investigator or investigating team, where such evidences are recovered, to make a request to the Digital Forensic and Crime Laboratory Services Department to carry out forensic analysis of the content of these devices. “In doing so, the investigator or investigating team, will include specifics to guide the forensic as to what is of utmost importance to the investigation. These specifics guide the Forensic examiner in narrowing down the analysis and search, extraction in these devices to areas of utmost importance as specified by the investigator or investigating team. On the request form, there is a section where the investigator may state these specifics. Examples might be SMS, Mails, pictures and websites”, Whyte said. While analyzing the forensics report, Whyte revealed that the defendant has running on his computer, a VPN called IP Varnish (a tool used to disguise identity and location of the user). According to him, “In relation to the contents found on the NOTES (a software application) on the devices of the defendant, wherein counterfeit card number was found alongside the details of the cardholder and an IP address, It would suggest that the only reason the possessor of this information will need an IP address attached to it, would be to satisfy the location specifics for consumption of transaction for merchants who require cards to be used only within countries and locations recognized by them. “If these cards were to be used on the internet from Nigeria, the browser that is stated here will attribute in real time the location of the user to the IP address. And If Nigeria is not the compliant location of the card issuer, the transaction will be blocked. But if this card when being used passes through a VPN and assigned with the IP address to conform with the compliant location of the card issuer, the Nigerian Location will be disguised and substituted to be Cardiff, thereby giving the merchant the impression that the card is being used from Cardiff or otherwise the compliant location” he testified. Counsel to the defendant, Senior Advocate of Nigeria, Olalekan raised objections to the evidence of witness. Ojo said “PW3 is attempting to give evidence on what must have operated on the mind of the user, as to why certain things were saved on the NOTE. The basis of my humble suggestion is that this witness is not competent to give evidence of the state of mind of the user of laptop without the existence of evidence before your lordship that the particular state of mind exists. He also added, “I wish to rely on the Provisions of S11(2) of Evidence Act in support of my objection. An investigating officer is not competent to ascribe a state of mind to any defendant. Whether the state of mind exists or not is a matter for judicial determination. PW3, though an investigator is not a psychologist but a forensic officer who cannot give evidence on the state of mind of a defendant”, he submitted. Responding to the objection raised by the defence, Oyedepo retorted that the objection raised by the SAN missed its target. He said “Firstly, the question being answered by the witness is to connect (if any), the relationship between Pages 8 & 27 of Exhibit E (the forensic analysis). The witness is not only competent to give that evidence, but in the circumstance of this case, is in the best position to bring life to it, by explaining the relevance of the report of the forensic analysis that he sought for and obtained. “I agree that the state of mind of the defendant is for the court to determine, however it is also the power of the court to rely on the facts and evidence supplied which is what PW3 is doing. “Finally, the witness has not used the word intention. The SAN is mainly imputing that the word “suggests” as used by PW3 is him interpreting that there was an intention by the defendant. He misconstrued the choice of words of the witness; I hereby urge the court to discountenance the submissions of the defense, Oyedepo concluded. In a short ruling, the Judge overruled the objection, saying that “the witness can give evidence on the reason he believes the defendant had those documents in his possession”.   Governor Abdullahi Umar Ganduje of Kano State has said that the presidential candidate of the All Progressives Congress (APC), Bola Ahmed Tinubu, picked Muslim as his running mate to mitigate special consideration given to religions in Nigerian politics. Ganduje, who is in the frontline of Tinubu’s campaign, disclosed this on Friday while briefing journalists at Unguwar Sabo Juma’at Mosque, Osogbo, Osun State. He said the biggest problems Nigeria faces are economy, employment and other developmental issues but not religion. He said, “We advised him (Tinubu) to pick Muslim as his running mate to end the religious consideration shown in Nigeria’s politics. “We, northern governors stand firmly that a presidential candidate must come from South so as to do away with all these differences.” Ganduje is in Osun as deputy chairman of the committee for the Saturday governorship election in the state.

  The Peoples Democratic Party (PDP) says it has uncovered an orchestrated plot by the All Progressives Congress (APC) to derail the nation’s democracy by compromising the integrity and sabotaging the will and desire of the people for a free, fair, transparent and credible electoral process in the Saturday July 16, 2022 governorship election in Osun State. Spokesman for the PDP, Hon. Debo Ologunagba, in a statement on Friday said the APC has accentuated its rigging programme by deploying billions of naira to compromise some security and electoral officers to intimidate voters, manipulate electoral process and inordinately favour the APC Candidate, Governor Gboyega Oyetola, against the will of the people. The PDP said it has been made aware of how huge sums of money have been funneled to certain compromised security and Independent National Electoral Commission (INEC) officials to execute this ignoble scheme. “The said INEC and security officials are reported to have been bought over to among other things, criminally assist and provide cover for APC agents to prosecute a well-oiled vote buying and violence-triggering scheme. “Our Party has information on how two prominent APC Governors from the South West, a former APC National Chairman from the South South, certain federal Minister and a particular member of the House of Assembly from Lagos State are coordinating the release of billions of naira to bribe electoral and security officials as well as fund heavily armed thugs imported from Lagos, Ondo, Ogun and other South West States to unleash violence and help the APC to rig the election. “The PDP alerts of a leaked report of how the APC released N20 million and N15 million respectively to two top police officers; N10 million to four Assistant Inspector General of Police, N5 million each to four Commissioners of Police, N3 million each to 15 Deputy Commissioners of Police, N2million each to 30 Assistant Commissioners of Police to compromise the electoral process. “Our Party also has further reports of how the APC released the sum of N10 million per Local Government Area for INEC officials in all the 30 Local Government Areas in Osun Steta, N7million to thugs masquerading as Amotekun officials and a huge sum of money for propaganda to a certain compromised media outfit. “The PDP has however been made aware that some patriotic INEC and Police officials vehemently rejected the poisonous offer by the APC. The PDP demanded that the Police and INEC immediately rejig their formations in Osun State as a step to assuage, reassure the electorate and prevent an impending crisis in the state.   Samuel Kanu-Uche, prelate of the Methodist Church Nigeria (MCN), says he will only support a presidential candidate who doesn’t engage in vote-buying. He spoke on Friday in Enugu at the graduation ceremony of 160 members of the church from the Enugu diocese, who were trained on various vocational skills. The prelate advised Nigerians against selling their votes, adding that politicians who engage in vote-buying have nothing to offer in terms of service to the nation. He, however, did not name which candidate he would support for the presidency. “I know that most of the candidates has nothing to offer, but any presidential candidate that shares money will not receive my vote,” NAN quoted him as saying. “Only those who have no money to share but offer themselves for service will get my vote.” Addressing the graduands, especially the women, he urged them to use their skills to contribute meaningfully to societal growth and national development.   “Our women are known for being industrious and never relied on their husbands or go after men. Rather, they use their sweat to help their husbands,” he said. “I believe the training you received today will add value to your family. I would not have gone to college if not for my mother who stood by her husband. “She never knew she was training a prelate of Methodist Church Nigeria. So, do not leave here today to go and relax.” The participants benefitted from a free training programme organised by the Potters Wheel Foundation (PWF), Enugu, which is owned and managed by Godsown Onuzulike and his wife, Chinwe.   The prelate commended the organisers for training church members free of charge, and prayed for God’s blessing upon the family.

Police arrest school principal, teacher over alleged rape of 14 year-old girl

  OYO state police command, on Friday, confirmed the arrest of principal of Federal Government Girl’s College, Oyo and a teacher over the allegation of rape of a 14-year-old student Recall that the family of the victim has demanded justice from Federal Government over alleged rape and molestation of their daughter by a teacher of the school, Timothy Alayoteti. Addressing newsmen in Ibadan, the elder sister to the victim, Mercy Gabriel lamented that after several months of the incident, her sister was still suffering from the trauma she went through. According to her, the family was forced to take the victim to a psychologist for check up, yet she still behaves abnormally. “My sister came home with our other siblings in a very sad mood. We probed her but she didn’t talk. But in about a months later, one of the PTA representatives followed her to me in my shop and the elderly woman narrated the whole story to me. “She confirmed to me that her teacher, Alayoteti raped her. Our parent went to the school but the principal said it was a mere rumor. At that time, no legal action was taken but we were forced to report the incident to Police in Oyo.” She added. Also confirming it, the Chairman, Parents/Teachers’ Association, PTA, of the school, Mr. Atanda Adesina said the association was in top of the case. A representative of the parent forum of the school, Mrs. Nancy Faniran said timely intervention of the parent forum led to the arrest of the suspect.

Osun poll: Police withdraw escorts from VIPs

  The Osun State Police Command has said that it has withdrawn escorts from all dignitaries and important personalities ahead of the election slated for July 16. Speaking on Channels TV, the Deputy Inspector-General of Police in charge of the Force Criminal Investigation Department, Johnson Kokumo, who is in charge of the Osun elections, said the police had informed the VIPs of the temporal withdrawal. He said, “There is a standing instruction that all those VIPs have police protection. We definitely have some categories of Nigerian individuals who are entitled statutorily to these kinds of protections, so we have equally told them that we are going to remove them. “We are removing them temporarily for the purpose of this election.” He further said that the force had issued identification tags for participating officers in the election, and warned that officers without the issued tag will be arrested. Kokumo was responding to questions on the preparedness of the police for the Saturday governorship election. He also noted that a number of 15 cult members had been arrested.

  The presidency on Friday debunked the report that there is an advisory from the Department of State Service, DSS to Predident Muhammadu Buhari warning against the choice of Muslim-Muslim ticket by the All Progressives Congress, APC, for the 2023 general elections. The presidency described the purported story by an online news platform as false. Recall that controversy and condemnations have trailed the choice of Senator Kashim Shettima a Muslim as the presidential running mate to Ashiwaju Bola Tunubu who is also a Muslim. A section of the country has claimed that the choice of Muslim/Muslim candidate did not reflect the religious diversity of the country. Besides, the purported online report had claimed that the DSS in its adisory to the President had raised the alarm on the negative security implication of such a pair. But reacting to the report, the Presidency in a statement issued by the Senior Special Assistant to the President on Media and Publicity, Mallam Garba Shehu, said, “We wish to advise well-meaning Nigerians to ignore a laughably puerile report by an apparently pirate online newspaper seeking to sow division and chaos on the choice of Governor Kashim Shettima as the Running Mate of our Party’s Presidential Candidate, Asiwaju Bola Ahmed Tinubu. “This so-called newspaper is like a deadly virus. Stay safe by keeping away from its toxic reports.”

  Kashim Shettima, running mate of Bola Tinubu, presidential candidate of the All Progressives Congress (APC), says Nigerians should look beyond religion when electing leaders. Shettima’s nomination as Tinubu’s running mate has drawn criticism from the public because both of them are Muslims. Speaking on Friday when he hosted an APC group led by Mohammed Hassan, a former Nigerian ambassador to the US, at his home, the former Borno governor said the task before him and Tinubu is to transform the country. The vice-presidential candidate added that there is no plan by Tinubu to Islamise the country. “Now, we are in the knowledge-driven age, in other clans, people are talking of nanotechnology, biotechnology, and quick data and of artificial intelligence, while we are busy here talking about herdsmen, farmers/herders clash, rural banditry, kidnapping, battling with Boko Haram and talking about religious mix,” NAN quoted him as saying. “The task before us is to transform this nation into a just and fair society where everyone will have a sense of belonging. We should learn to accommodate and embrace each other. “They are accusing him of an attempt to Islamise the country. Has he started with Islamising his own family? “Asiwaju Bola Ahmed Tinubu, yes, his running mate might be a Muslim, but his life mate for over 40 years is not only a Christian, but a pastor at the Redeemed Christian Church of God. “He did not enforce his own Islamic faith on his own children. He was the first governor to hand over mission schools to the owners, and he has groomed people from all walks of life.” On his part, Hassan said they were in Shettima’s home to inform him of an upcoming town hall meeting where the APC candidates can discuss their plans for Nigeria.

  The Katsina Police Command on Friday said its men arrested one of the escapees from the recent Kuje prison jailbreak. According to the police, the 33-year-old escapee, Kamal Abubakar, was re-arrested on Thursday evening in Danmusa Local Government Area of Katsina state, during a raid on suspected criminal hideouts in the council. Some quantities of dried leaves suspected to be Indian hemp were also reportedly recovered on him during a police search. The spokesman for the Katsina police command, SP Gambo Isah, made the revelation during a press briefing at the command’s headquarters, Katsina. He said, “On 14, July, 2022 at about 6 p.m, based on credible information, DPO Danmusa, and team carried out raids at suspected criminal hideouts in Danmusa LGA and succeeded in arresting one Kamala Lawal Abubakar, aged 33yrs of Unguwar Sale Quarters, Danmusa LGA, a suspected fugitive from Kuje prison, Abuja. “In the course of investigation, suspect confessed to have escaped from Kuje Prison, Abuja, during the recent Kuje jail break. Some quantity of dried leaves suspected to be Indian hemp was also recovered in his possession during a police search. The suspect will be handed over to Nigerian Correctional Service, for further necessary action.”

  A 33 year old, Kamala Lawal Abubakar, of Unguwar Sale Quarters in Danmusa Local Government Area (LGA) of Katsina State has been arrested by the police in the state. Abubakar who is suspected to be a fugitive from Kuje prison, Abuja was arrested yesterday evening, based on credible information that spurred the Divisional Police Officer of Danmusa and his team to carry out raids on suspected criminal hideouts within the LGA of the State. In the course of investigation, the suspect confessed to have escaped from Kuje Prison, Abuja, during the recent Kuje jail break. Police spokesman, SP Gambo Isah in a statement on Friday stated that some quantity of dried leaves suspected to be Indian hemp was also recovered in Abubakar’s possession during police search. He said the suspect will be handed over to Nigerian Correctional Service, for further actions. Investigation is ongoing. “On 2/07/2022 at about 2233hrs, based on a tip off, the command succeeded in arresting one Bello Sale Jino, ‘M’, aged 25yrs of Modoji village, a notorious leader of kidnap for ransom syndicate and a suspected terrorist. He was arrested in a hideout at Bakuru village, Katsina. “In the course of investigation, suspect confessed to be a leader of kidnap for ransom gang and was in the village based on the invitation of one Mustapaha Badamasi, that he should come to the village and take a survey of a rich man in the village, who has plenty of cows. “Furthermore, suspect confessed to have kidnapped many people within Katsina metropolitan and collected ransom ranging from eighty thousand (N80,000) to two hundred thousand (N200,000) naira. Some of his gang members arrested include (1) Muhammed Ibrahim, ‘M’, aged 25yrs of Sokoto Rima Quarters, Katsina (2) Anas Abdullahi, ‘M’, aged 30yrs of Sabon Gida Quarters, Katsina and (3) Mustapha Badamasi. Investigation is ongoing. “On 07/07/2022 at about 1700hrs, the Command succeeded in arresting suspected killers of one Mallam Dayyabu, ‘M’, of Majifa village, Kankara. “The fact of the case is that on 10/06/2022 at about 1400hrs, the following suspects (1) Kane Kasimu, ‘M’, aged 35yrs, (2) Yahaya Danmallam, ‘M’, aged 30yrs (at large) (3) Aminu Ba’are, ‘M’, aged 40yrs (at large) (4) Sirajo Dawai, ‘M’, aged 18yrs (at large), (5) Ibrahim Amadu, ‘M’, aged 60yrs (6) Sa’idu Ibrahim, ‘M’, aged 30yrs, all of Gidan Dangwari village, Kankara, attacked the said Mallam Dayyabu while working in his farm land and thereafter attacked his wife at home with intent to kill her but did not met her but destroyed some part of the house. Suspect confessed to the commission of the offence. “On the 29/6/2022 at about 0700hrs, the command succeeded in arresting the trio of (1) Ayuba Abudullahi ‘m’ aged 25 years old alias Arrow (2) Sagir Sade ‘m’ aged 22yaers and (3) Usman Shu’aibu ‘m’ aged 22 years old. “Nemesis caught up with the syndicate when attack the residence of the duo of one (1) Sterling Anikezie ‘m’ and (2) Ayingor Sunday ‘m’ all of Malumfashi town and robbed them of Two (2) Tecno android handset valued at one hundred and five thousand naira (₦105,000.00). “One laptop computer valued at one hundred and fifteen thousand naira (₦115,000.00). The sum of one hundred and sixty-five thousand naira (₦165,000.00),” SP Gambo Isah revealed. The police spokesman also explained that during the course of the investigation, suspects were arrested hibernating in the house one Hadiza Mamman alias Uwani ‘f’ aged 37 years old in possession of six (6) package of banned substance solution. According to him, the suspects will be further investigated after which they will be charged to a competent court for onward prosecution.
