N18.8bn Investment Fraud: Court Orders Ajetunmobi Couple To Pay 27 Scammed Investors

  The Lagos High Court Sitting in Osborne, Ikoyi has delivered judgment in favour of 27 aggrieved Nigerian investors/claimants who were scammed by a Nigerian couple, Bamise and Elizabeth Ajetunmobi who allegedly fled the country after duping them of N18.8 billion. Justice Toyin Oyekan-Abdullahi ordered the defendants to pay the sum of 18.8bn with interest. At a previous proceeding, the court had earlier frozen funds and properties of the defendants worldwide as well as all monies standing to their credit. The defendants in the suit are Imagine Global Holding Company Ltd, Imagine Global Solutions Ltd, and the Nigerian couple, Bamise and Elizabeth Ajetunmobi. The two firms and the Ajetunmobi couple have been associated with an N18.8bn investment fraud by some aggrieved Nigerian investors who filed the suit before the court. According to the claimants, the sum is the outstanding investments and return on investments accruing to them from the defendants. In reaching its judgment today, Justice Oyekan-Abdullahi dismissed all the preliminary objections filed by the defendants, while the court exited CBN from the proceedings. The court granted the reliefs sought by the 1st to 17th claimants’ counsel- Adetunji Adedoyin-Adeniyi in the sum of N15.5 Billion and the rest of the Claimants’ represented by the law firm of Banwo and Ighodalo in the sum of N3.3 Billion totalling the sum of 18.8 Billion. The reliefs granted by the court are: 1. A DECLARATION that this Honourable Court is clothed with jurisdictional competence to enforce the written contracts executed between the parties herein vide this Originating Summons, on the ground that the underlying issues borders on interpretation of written contracts, that arose out of the Claimants’ respective investment agreements and the failure of the Defendants to comply with the terms of the said agreements. 2. A DECLARATION that the Defendants’ failure to comply with the terms of the Investment Agreements executed between the Claimants and the 2nd Defendant, vis-à-vis, the failure of the Defendants to pay the Claimants their investment sums as agreed in the confirmation of investment, constitute a breach of the contract validly entered between the Claimants and the 2nd Defendant. 3. ‘We want young candidate’ — APC groups reject Shettima as Tinubu’s running mate

  A coalition of support groups in the All Progressives Congress (APC) has rejected Kashim Shettima, a former governor of Borno, as the running mate of Bola Tinubu, the party’s presidential candidate. In a communiqué on Wednesday, 28 leaders of the support groups in the coalition said they want a “young” vice-presidential candidate. While calling on Tinubu and the party to pick Ibrahim Bello Dauda, an APC chieftain, the groups said they want to ensure a more-inclusive governance process. Dauda is the former national coordinator of the Muhammadu Buhari media support group. “We, substantive members of coalition of All Progressives Congress Support Groups, here speaking in one voice and unanimously rejecting in totality the recent announcement of former Governor of Borno State, Senator Kashim Shettima as the running mate to the Presidential Candidate of APC, Asiwaju Bola Ahmed Tinubu,” the communique reads. “We emphasise on the fact that this coalition of APC support groups has found Ibrahim Bello Dauda, a true detribalised Nigerian youth leader worthy to be the running mate and Vice President to His Excellency Asiwaju Bola Ahmed Tinubu in the next political dispensation. “This group cannot but reflect on the fact that most of these political leaders became ministers and governors at their prime youthful age of late 30s and 40s, and were given that opportunity and support by the elders and leaders. “The question now begging for answers is: Why now are they frustrating youths who are eminently qualified to be selected as vice presidential candidate? “The ruling APC and its leadership should hearken to the voice of the Nigerian youth now, as this will reaffirm the much-touted promise made by the ruling party APC on youth inclusion in governance. “The youths will no longer play the role of only supporting the old politicians. Queues disappear as marketers hike petrol pump price

  Oil marketers yesterday unilaterally raised the pump price of petrol from N165 per litre to N185 in disregard to the Federal Government approved pump price of N165 per litre. The hike which came a day after Major Oil Marketers Association of Nigeria, MOMAN, said the current price was no longer realistic saw the disappearance queues at filling stations around Abuja metropolis. Checks at some filling stations by Vanguard showed that while some stations raised the price by just N10 per litre, most hiked the price by N20. At NIPCO filling station in Mabushi District, the price was N175 per litre with few vehicles in the station. Speaking to Vanguard, a motorist who identified himself as Mallam Ibrahim noted that it was better to buy N175 per litre than to spend four hours on the queue waiting to buy at N165 per litre. He said: “My friend, is this not better? Why should we spend so much time just to buy petrol? Even though I do not support full deregulation because of its impact on the price of goods, the government should have raised the price a little to accommodate the complaints of the marketers and save people the agony of queuing every time for fuel”. At Mobil filling station in Karu, the price was N185 per litre without queues also. However, the price remained at N165 per litre at TotalEnergies filling station at Central Business District. Speaking on the development, the Public Relations Officer, Independent Petroleum Marketers Association of Nigeria, IPMAN, Chief Chinedu Ukadike said it was expected as marketers have to cover their cost of operation. Ukadike explained that the marketers have been running at a loss these past months, pointing out that most stations closed down because of this. According to him, “Abinitio, we have also stated that there is no way marketers will buy products from private depots who are now selling at N170 and some at N167 depending on the area the tank farm is situated. These private tank farms owners have made it clear that they cannot sell at government approved price. “Marketers cannot buy at N167-N170 and you expect them to sell at N165. This is why marketers have looked at the high cost of logistics because diesel is at N850 per litre now and to transport product from these wet areas to dry areas cost a lot of money. “If you look at Abuja you will see that it does not have any depot that supplies petroleum products. All petroleum products in Abuja, Kano and other northern areas of the country are being taken from wet areas like Lagos, Calabar and others which have seaports. “The products are all imported and Nigeria is heavily dependent on imports because the refineries are not working. So the private tank farms are now used to supply petroleum products to marketers. We are now left in their hands and whatever they sell to us, we will mark up our margins and sell to customers, the end users”, he added. He explained that pump prices would vary from one filling station to another across the country because of where the product was sourced by the marketer. “While those (marketers) in Calabar might buy at N170 or those in Port Harcourt at N162 or those in Lagos at N163 depending on how the tank farm owner got his product, if you include cost of logistics and the numerous taxes government have imposed on us, then the end result is what you are seeing”, he stated.

ICPC to probe MDAs over COVID-19 intervention funds

  The Independent Corrupt Practices and Other Related Offences Commission has vowed to investigate some Ministries, Departments and Agencies of Government for infractions on COVID-19 intervention funds and other procurement abuses. Speaking at the 2022 African Union Anti-Corruption Day, the Chairman of the ICPC, Prof. Bolaji Owasanoye, SAN, stated that the Commission had observed discrepancies and infractions in the procurement and payments made by some ministries and agencies after the disbursement of the COVID-19 fund. He said, “The Commission, he added, also observed that in some instances the distribution of relief materials or palliatives was chaotic, disorderly and uncoordinated. “The Commission had observed discrepancies and infractions in the procurement and payments made by some ministries and agencies after the released and appropriate disbursement of COVID-19 funds. Some implicated MDAs refused the monitoring team access to their records thereby impeding the successful inquiry into their activities. These MDAs are flagged and will be investigated for breaches and infractions of the law and COVID-19 intervention funds guidelines and other procurement abuses. “Hoarding and diversion of materials were also common warranting the raids by people in some situations, facilities or locations warehousing palliatives. Some of such also created widespread violence.” Owasanoye citing media reports also lamented selective distribution, favouritism, nepotism and other biases in the allocation and distribution of palliatives as well as the highjacking of palliatives by political actors, their proxies, cronies, and affiliates.

EXTRA: Baba Ijesha took his acting too far – Judge

  Justice Oluwatoyin Taiwo of an Ikeja Special Offences Court on Thursday held that Nollywood actor, Olanrewaju James, alias Baba Ijesha, convicted for defiling a 14-year-old, took his acting too far. The News Agency of Nigeria (NAN) reports that Taiwo sentenced Baba Ijesha to 16 years’ imprisonment for defiling a minor. The judge sentenced the convict to five years’ imprisonment on count two, three years on count three, five years on count four and three years on count five of the six~count charge he faced. She, however, said that the sentencing, which must take effect from July 14, should should run concurrently. “The defendant took his acting too far. Children are frequently preyed on because of their inability to defend themselves. “However, the court is not distracted. The defendant abused the position of friendship. “This case brings to the limelight various sexual assault cases in the society despite the efforts of government and non-governmental organisations to sensitise the public on incessant cases of sexual assault. “The is very sad. The behaviour of the defendant is appalling, as this shows the length people can go in exhibiting the animalistic urge in them,” she said. The judge remarked that the case attracted frivolous comments on social media because of the personality of the actor. NAN reports that Baba Ijesha broke down in tears after the judge pronounced the judgment. He was surrounded by his colleagues in the movie industry. NAN also reports that his counsel, Mr Gabriel Olabiran, had prayed the court to consider the least sentence for him. Olabiran said that the convict was a first-time offender and had passed through trauma of incarceration both at the State Criminal Investigation Department, Panti, Yaba, and at the Kirikiri Custodial Centre. “There is no doubt that the defendant is very remorseful. My lord, we pray you to consider the fact that the defendant is an actor who has impacted positively on the society in the course of his career. “We urge your lordship to be lenient with the defendant who has lost almost all his image all over the world and will be deserted by his colleagues in the movie industry. “He has an aged parents, wife and son who depend on him; they look up to him coming back home. We assure the court that the defendant is a changed person who will not go back to his vomit. “We urge the court to be merciful unto him and consider the least sentence,” Olabiran said. Prosecution team led by Lagos State Director of Public Prosecution, Dr Babajide Martins, left the sentencing at the discretion of the court. “The law has taken its course. The offences that my lord has found the defendant liable have custodial sentencing. “Count two is for seven years, count three is for four years, count four is liable for seven years and count five is for three years. “We, however, leave the sentencing at the discretion of the court,” Martins said. Baba Ijesha faced six counts of child defilement that included indecent treatment of a child, sexual assault, attempted sexual assault by penetration and sexual assault by penetration. The Lagos State Directorate of Public Prosecutions, which proffered the charges against the actor, argued that the offences contravened Section 135, 137, 261, 202, 262 and 263 of the Lagos State Criminal Law 2015, which stipulates up to life imprisonment for offenders. Baba Ijesha pleaded not guilty to all the counts on arraignment. (NAN)

Varsity strike: Why FG rejects Report of Briggs Committee, Presidency Source

  INDICATION emerged on Thursday that the Federal Government may have rejected the Nimi-Briggs Committee ovon the alleged allocation of pay rise of 180 percent to university teaching staff, while the non teaching staff were given 10 percent. The Federal Government had set up the Briggs-led committee to renegotiate the 2009 Agreement between the government and the university based unions, the Academic Staff Union of Universities, ASUU, the Senior Staff Association of Nigerian Universities, SSANU, the Non-Academic Staff Union of Allied and Educational Institutions, NASU and the National Association of Academic Technologists, NAAT. Recall that public Universities in the country have been shut down since February 14 over some contentious issues including the renegotiation of the 2009 Agreement, disagreement in salary payment platform among others. But sources at the Ministry of Finance accused the Briggs Committee of connivance with ASUU in proposing an impracticable increase in the university wage structure where a Professor is to earn N2 million a month. The sources close to the Presidential Committee on Salaries and Wages alleged that though Prof. Briggs is the Pro-chancellor of the Federal University, Lokoja, he still teaches at the University of Port Harcourt hence the alleged conspiracy to make a pay rise of about 180 percent for teaching staff, while the non teaching staff was given a paltry pay rise.   The sources close to the Presidential Committee on Salaries and Wages alleged that though Prof. Briggs is the Pro-chancellor of the Federal University, Lokoja, he still teaches at the University of Port Harcourt hence the alleged conspiracy to make a pay rise of about 180 percent for teaching staff, while the non teaching staff was given a paltry pay rise. Besides, the source claimed that ASUU in collaboration with the Committee excluded the relevant advisory Ministries, Departments and Agencies, MDAs that were key to the negotiation. The relevant MDA’s that were excluded according to multiple sources are the Ministries of Finance, Education, Labour and Employment, Budget Office of the Federation, Office of the Head of Service of the Federation, National Salaries, Income and Wages Commission from the sittings of the committee. According to the sources, “These are critical MDAs that manage the finances of the Federal Government, its receipts and expenditures as well as administer the public service of the federation. “Their exclusion from the sittings of Prof. Nimi Briggs easily explains its non-inclusive and one-sided proposal, recommending sky-high, impracticable figures in salaries and allowances that are clearly beyond the capacity of the Federal Government. “How can you discuss the service condition of a section of the public service of the federation without the Office of the Head of Service of the Federation or salaries and wage structure without contributions from the Minister of finance, Budget Office or National Salaries, Income and Wages Commission? “To the exclusion of the Presidential Committee on Salaries? This is an anomaly. And how could the Briggs Committee skate over such a grave issue,” the source asked. According to findings by our reporter, Briggs Committee proposed a professor to earn N19.5 million per annum and when other allowances are added, will scale up to N23 million per annum, making it about N2 million monthly. The allowances include post-graduate supervision allowance, Teaching Allowance, Field trip allowance, responsibility and Post graduate supervision allowance, Hazard allowance, examination/time keeper allowance, teaching practice/industrial supervision allowance. Others include honoraria for post graduate thesis(oral exam) honoraria for external modulation programme for undergraduate/ post graduate students, allowance for external assessment of readers/professors as well as allowance for the post graduate study grant, besides other fringe benefits. One of the sources said that the government side – the Presidential Committee on Salaries has taken a decision for a holistic, all-encompassing and integrated review of the salaries and allowances of the entire educational sector – universities, polytechnics and colleges of education. Hence, the Committee has been mandated to go back to the drawing board to produce a reasonable, practicable wage increase, which will reflect relativity of every worker in the educational sector – academic and non- academic. This the source explained was to avoid a situation where government will solve a problem from one section of the education system and inadvertently opens conflagration from a different flank. It said that this is because the request for the increase of salaries of polytechnics staff as well as that of health workers- doctors and JOHESU members is still waiting for the response of the Federal Government. Another source told our correspondent that Government is amenable to a general wage review and intends to achieve it in a manner the promotes the best interest and overall progress of all sectors of the nation’s workforce. It however regretted that while doctors and Joint Health workers as well as staff of polytechnics, whose requests for wage increase is pending before government have shown patriotism, choosing to stay at work while pressing home their demand, ASUU wants N1.1 trillion yearly for the university system alone or keep the universities shut. According to the source, the Minister of Finance has explained that paying this amount is not doable, even if the Federal Government decides to collapse a big chunk of its capital vote. Urging ASUU to return to work while the Federal Government sorts this tricky wage increase in manner that does not unsettle relativity and general wage equilibrium in the federal public service, having in mind also, the finances of the nation, it lamented that incessant strike by ASUU is at the root of the decay and consequent de-marketing of the nation’s universities. The source said, “ASUU made the Committee work without government officials from the Ministry of Finance, Budget Office of the Federation, National Salaries, Income and Wages Commission, Office of the Head of the Civil Service of the Federation and Ministry of Labour and Employment. “These government organs are to provide advice to the committee while the Ministry of Education and the National University Commission are the direct employers. “The Ministry of Finance and the Budget Office

  The Peoples Democratic Party (PDP) presidential candidate, Atiku Abubakar, his running mate, Governor Ifeanyi Okowa and other officials on Thursday arrived in Osun State in honour of the party’s candidate, Senator Ademola Adeleke. This is coming two days to the governorship election in the state where Adeleke has once again attempted to govern the state having lost to the incumbent governor, Gboyega Oyetola in 2018. Also in attendance was popular musician, Davido, Governors Godwin Obaseki (Edo), Aminu Tambuwal (Sokoto), Duoye Diri (Bayelsa), former Vice President Namadi Sambo, ex-Osun Governor, Olagunsoye Oyinlola. Saraki, who mounted the podium, recalled that the party was robbed of its opportunity to govern the state in 2018. He charged the people to get their Permanent Voter Cards (PVC) to vote out the APC by ensuring that Adeleke is elected as governor on July 16. In his remarks, Atiku Abubakar charged the people to vote for Adeleke on Saturday and protect their votes. Protest: Sri Lanka President Submits Resignation – Official

  Sri Lanka’s president submitted his resignation Thursday shortly after reaching Singapore, the parliamentary speaker’s office said, days after the head of state fled protests triggered by his country’s worst-ever economic crisis. Gotabaya Rajapaksa resigned by email, the speaker’s spokesman said hours after he landed in the city-state after protesters overran his palace on the weekend. Rajapaksa fled to the Maldives on Wednesday and left there for Singapore a day later. “The authenticity and the legality of the e-mail will have to be checked out” before being formally accepted, Indunil Yapa told AFP, adding a formal announcement was expected on Friday. Rajapaksa would be the first president to resign since Sri Lanka adopted a presidential system of government in 1978. As president, Rajapaksa enjoyed immunity from arrest, and he is believed to have wanted to go abroad before stepping down to avoid the possibility of being detained. Under Sri Lanka’s constitution, Prime Minister Ranil Wickremesinghe – whose resignation is also being demanded by protesters – would automatically become acting president until parliament can appoint a successor. Rajapaksa, his wife Ioma and their two bodyguards arrived in Singapore from Male on board a Saudia airline flight. Singapore’s foreign ministry confirmed Rajapaksa had been allowed to enter the city-state for a “private visit”, adding: “He has not asked for asylum and neither has he been granted any asylum.” A handful of Sri Lankans was waiting in one of the airport’s arrival areas to voice their anger at Rajapaksa and the economic crisis engulfing their homeland. “I want to scold him with all the words that I know,” said a Sri Lankan design engineer working in Singapore, who identified himself only as Max. “He’s responsible for everything that happened in our country,” he told AFP. Singaporean authorities were quick to warn against protests – it is illegal for even one person to stage a demonstration without prior official permission in the tightly-controlled territory. Rajapaksa is expected to look to stay in the city-state for some time, according to Sri Lankan security sources, before potentially moving to the United Arab Emirates.

Muslim-Muslim ticket: Make a change now, Ohaneze tells APC

  THE Vice President-General of the apex Igbo socio-cultural organization, Ohanaeze Ndigbo, Ichie Damian Okeke-Ogene has described the All Progressive Congress, APC, presidential candidate, Bola Tinubu’s decision to pick a fellow muslim as his Vice Presidential candidate for the 2023 election as a serious threat to the unity and corporate existence of Nigeria.   Addressing reporters in Awka, Okeke-Ogene, however told the APC presidential candidate that it is still not too late to correct the anomaly as he could change his running mate before the deadline. Describing Nigeria as a multi-religious and multi-ethnic country, the Ohaneze leader made it clear that any attempt by one religion to dominate the political structure could only widen the gap of mistrust and destroy the delicate sense of tolerance cultivated over the years. According to him, the choice of the muslim — muslim ticket was not only ill-timed, but also a total disregard to the diversity of the country, noting that it had undermined efforts of well- meaning Nigerians over the years to bridge the religious differences and promote ethnic harmonious co-existence. He said Tinubu’s desperation to be President of Nigeria has thwarted efforts and sacrifice of former President Goodluck Jonathan to consolidate on corporate existence of the country when he stated that his political aspiration was not worth shedding the blood of any Nigerian, He observe that from the actions of the APC presidential candidate, it would appear he is not interested in the unity and peaceful co-existence of Nigeria as a country. Okeke-Ogene commended the leadership of Pan Yoruba socio-political organization, Chief Ayo Adebanjo and the convener Pan Niger Delta Forum and Ijaw leader, Chief Edwin Clark for remaining vocal and speaking out on issues affecting Nigerians, noting that South-West and South-South socio-cultural organizations have been consistent in pointing out the injustice meted out to South-East Zone and have been supporting agitations for equity, fairness and good conscience. Okeke – Ogene also spoke on the presidential candidate of Labour Party Mr. Peter Obi, arguing that he represents the face of new Nigeria without any ethnic coloration, noting that his emergence has engendered a tsunami-like movement across the country made up of Nigerians from all the ethnic groups in the country. He assured that Ohanaeze Ndigbo would give Obi the necessary support and encouragement, like other Nigerians to actualize his aspirations and change the narrative in the country. He urged the New Nigeria Movement supporting Obi and the Labour Party to disregard those speaking from both sides of their mouths, expressing satisfaction that youths of Nigeria were out and determined to take ownership of their country and make a clear difference. He also expressed hope that votes of the electorate would count in the 2023 presidential election to give birth to a new Nigeria.
