Anti-Yoruba nation Lagos rally postponed

The Yoruba Appraisal Forum has postponed its `Anti Secession Agitations’ rally expected to hold at Gani Fawehinmi Park, Lagos State on Friday. The organisers said the rally was postponed after police intervention and a need to curb COVID-19 spread. The Commissioner of Police (CP) in Lagos State, Mr Hakeem Odumosun, in a statement after meeting with Animashaun on Thursday at the command’s headquarters, said that any rally or mass gathering in any part of the state would expose the participants and innocent residents to traffic problems, health hazards and avoidable security infractions. The YAF national coordinator, Chief Adesina Animashaun, made this known on Friday. He said, “I met with the CP on Thursday afternoon and the reasons he gave for us to postpone the really are ideal. “The CP also asked me to sign an undertaking to call off the rally, walk to forestall gridlock, new wave of COVID-19, among others, which I did. “As a law-abiding citizen, I realised that the reasons given by the CP are ideal. “However, our sensitisation about the need for one Nigeria is not something we push under the carpet. The rally will eventually hold at a later date that we will decide.” The PUNCH had reported that personnel of the Lagos State Police Command on Friday surrounded the Gani Fawehinmi Park, Lagos State over a planned anti-Yoruba nation rally by the Yoruba Appraisal Forum. The police had said that intelligence revealed that the group was mobilising for a mega rally in the state on Friday despite the arrest of some agitators at the July 3 rally which took place at the Gani Fawehinmi Freedom Park, Ojota. The police command, in a statement issued and made available to reporters on Thursday evening, urged parents and guardians to warn their children and ward against such activities in the state. The statement titled, ‘Re: Yoruba Appraisal Forum’s Rally: Police Ban Rally, Warn Organizers To Steer Clear Of Lagos’ was issued by the state’s Police Public Relations Officer, Muyiwa Adejobi. “The Police and other security agencies in the state have been on red alert to prevent any unlawful rally and lawlessness in any part of the state, while parents and guardians are urged to warn their children and wards not to involve themselves in any such activity which may portend danger to the state. “The ugly incident recorded at the Oodua Republic Rally of 3rd July, 2021, at the same area of Ojota, Lagos State, is still fresh in our memories, let alone the massive destruction of lives and properties experienced during the October 2020 End SARS violent protest in Lagos State,” part of the statement read.

Niger state to hang convicted kidnappers, informants

Abubakar Bello, governor of Niger state, has signed a bill prescribing death by hanging for cattle rustlers, bandits, kidnappers and their informants into law. The Niger house of assembly passed the bill on July 1. Bello said the kidnapping and cattle rustling special provisions law of 2016 was amended to provide for the punishment of informants and all those involved in the aiding and abetting of kidnapping and cattle rustling in the state. He said informants who aid and abet kidnappers will now have to face death by hanging in public. “The law now provides that whoever instigates any person to kidnap a person or rustle cattle, or intentionally aids, abets or facilitate by any acts of omission or commission of the offence of kidnapping and or cattle rustling is guilty of an offence and is liable on conviction to death by hanging in public,” he said. The governor said the punitive measure became necessary owing to the security challenges that have continued to threaten peaceful coexistence in the state. He lamented the role of informants who, according to him, have contributed to thwarting efforts of the security agencies in combating the activities of kidnappers and cattle rustlers. He said the vigilante amendment law is meant to invigorate and strengthen the state vigilante corps for better operational efficiency in the discharge of their statutory function of “complementing the efforts of our conventional federal security forces”.

Heavy security presence over planned rally in Lagos

Security operatives have cordoned off the Gani Fawehinmi Park in Ojota, Lagos over a planned rally. The Nation observed scores of armed security men, including Police Officers, RRS operatives, Lagos State Task Force and Lagos State Neighborhood Security Watch (LNSC) were stationed at strategic points to prevent any rally. Police water cannon, vans, black maria and armoured RRS tanks were also sighted at the venue of the proposed rally. There is traffic girdlock in Ojota and surrounding areas over roadblocks mounted at the section leading to the park. It was gathered a non-government organisation, Yoruba Appraisal Forum (YAF) had planned a peace rally for Friday. But Lagos Police Command had warned the forum against holding any rally in the State. Court sentences man to death by hanging for armed robbery

A High Court in Abeokuta, on Friday sentenced a 44-year-old man, Tosin Shodunke to death by hanging for armed robbery. Shodunke had pleaded not guilty to the two counts of conspiracy and armed robbery. Delivering judgment, Justice Ayokunle Rotimi-Balogun, held that the court was convinced beyond reasonable doubt that the convict was guilty as charged. Rotimi-Balogun, held that all evidence presented by the prosecution was tenable and therefore sentenced the convict to death by hanging. Earlier during trial, the Senior state Prosecution Counsel, Mrs Akinola Oluwabunmi, told the court that the convict committed the offence on Sept. 2, 2016, at about 9 pm at No 9, Ogunsanya street, Kugba Adatan area in Abeokuta. Oluwabunmi said that the convict conspired with two others, now at large, while armed with a locally-made gun, entered into the Shop of Mr Clement Osinanchi, a trader and robbed him of N113, 000 cash. The prosecutor said that the offences contravened the provisions of sections 6(b) and 1(2)(a) of the Robbery and Firearms (special provisions) Act, Cap Rll, Laws of the Federation of Nigeria, 2004. BREAKING: Opposition Lawmakers Stage Walkout Over Electoral Act Amendment Bill

Lawmakers from the opposition Peoples Democratic Party (PDP) have staged a walk-out over clause 52 of the Electoral Act Amendment Bill. They insist that the clause was never carried. They also insist that they will disrupt the proceedings when the House resumes from recess. The new amendment provides that INEC may consider electronic transmission so far as the national network coverage is adjudged to be adequate and secure by Nigeria Communication Commission (NCC) and approved by the National Assembly. But they have been unable to reach an agreement. On Thursday, the representatives had also gone into a rowdy session after Deputy Speaker Idris Wase ruled against the electronic transmission of results despite a resounding vote in favour of electronic transmission. Subsequently, the Speaker, Femi Gbajabiamila, announced that the Independent National Electoral Commission (INEC) and the NCC would be present on Friday to give further clarifications on the Electoral Act with a major focus on section 52(3). Another rowdy session, however, broke out afterwards.

Electronic Transmission Of Results: We Can’t Guarantee 100% Safety – NCC

The Nigerian Communications Commission (NCC) has said it cannot guarantee total safety for the electronic transmission of results, explaining that no system is completely free from hackers. Federal lawmakers had a rowdy session as debates over the inclusion of electronic transmission of results in the Electoral Act Amendment took centre stage in the chambers on Thursday in Abuja. But the Executive Commissioner of the NCC, Adeleke Adewolu told lawmakers at the House of Representatives on Friday that while concerns over the electronic transmission of results are genuine, no system can guarantee a 100 percent shield from hacking. The NCC boss also stated that elections results can only be transmitted by a 3G network, noting that 50 percent of the country has 3G coverage. He, however, explained that for areas without such coverage, poll results can be recorded and thereafter uploaded in places where there is a network. But Adeleke admitted that this cannot be compared with the real-time upload. The House of Representatives had failed to reach an agreement over the controversial clause. This was after Deputy Speaker Idris Wase ruled against the electronic transmission of results despite a resounding vote in favour of electronic transmission. Subsequently, the Speaker, Femi Gbajabiamila, said the Independent National Electoral Commission (INEC) and the NCC would be present on Friday to give further clarifications on the Electoral Act with a major focus on section 52(3). The Senate had on the same day voted for the conditional electronic transmission of election results. At the end of voting, 28 Senators mostly from the main opposition Peoples Democratic Party (PDP) voted for the original amendment in the report while 52 Senators backed the amendment as proposed by Senator Sabi Abdullahi. This means the majority of Senators voted that INEC may consider electronic transmission provided the national network coverage is adjudged to be adequate and secure by NCC and approved by the National Assembly.

NBC asks broadcast stations not to report details of insurgent/bandit attacks

The National Broadcasting Commission (NBC) has asked broadcast stations in Nigeria not to report the details of attacks by bandits and insurgents. In a letter dated July 7 and signed by Francisca Aiyetan, director of broadcast monitoring, the NBC directed radio and television stations not to “glamourise the nefarious activities of insurgents, bandits and kidnappers ” in their reports. The letter was titled ‘Newspaper Reviews And Current Affairs Programmes: A Need For Caution’, and was signed on behalf of Balarabe Ilelah, director-general of NBC. The commission advised broadcasters to apply caution in their reportage as divulging “too many details” may have an adverse effect on the efforts of the Nigerian security agencies. The NBC said some of the topics discussed during daily newspaper reviews have “ethnological coating” which pitches “one section of the country against the other and leaving Nigerians in daily hysteria”. “Headlines of most Newspapers on a daily basis are replete with security topics. While bringing information on security to the doorsteps of Nigerians is a necessity, there is a need for caution as too many details may have an adverse implication on the efforts of our security officials who are duty-bound to deal with the insurgency,” the letter reads. “The commission, therefore, enjoins broadcasters to collaborate with the government in dealing with the security challenges by; “Not glamourising the nefarious activities of insurgents, terrorists, kidnappers, bandits etc. “Advising guests and/or analysts on programmes not to polarise the citizenry with divisive rhetoric, in driving home their point. “Not giving details of either the security issues or victims of these security challenges so as not to jeopardise the efforts of the Nigerian soldiers and other security agents.” The commission also asked that broadcast stations be guided by provisions of sections 5.4.1(f) and 5.4.3 of the NBC Code which states thus: “The broadcaster shall not transmit divisive materials that may threaten or compromise the divisibility and indissolubility of Nigeria as a sovereign state. “In reporting conflict situations, the broadcaster shall perform the role of a peace agent by adhering to the principle of responsibility, accuracy and neutrality.”

Tambuwal blasts Senate: You can’t subject INEC to NCC

Governor Aminu Tambuwal said it is unconstitutional for the Senate to subject INEC’s power to conduct elections to the Nigerian Communications Commission (NCC). Tambuwal, a former Speaker of the House of Representatives and lawyer, said INEC constitutional power could not be shared with any institution. “For the avoidance of doubt, S.78 of the Constitution provides that ‘The Registration of voters and the conduct of elections shall be subject to the direction and supervision of Independent National Electoral Commission’.” “In the Third Schedule, Part 1,F, S.15: INEC has power to organise, undertake and supervise all elections. “The Constitution further provides that INEC operations shall not be subject to the direction of anybody or authority.” Tambuwal, who is the governor of Sokoto, said that unquestionably, the mode of election and transmission of results were critical parts of the conduct, supervision, undertaking and organisation of elections in Nigeria. “Of course, the National Assembly has power to flesh out the legal framework but that has to be consistent with the Constitution. “These constitutional powers have been solely and exclusively prescribed by the constitution to INEC, and cannot be shared with the NCC, or any other authority, and certainly not a body unknown to the Constitution.” Tambuwal said that the senate decision to subject INECs constitutional power to conduct elections to NCC was consequently patently void, unconstitutional and unlawful. “We had earlier counselled that that the mode of conducting elections and in particular the transmission of votes be left with INEC who would monitor developments and determine at every election the type of technology to be deployed to ensure free, fair and credible elections. “INEC also has constitutional power backed by the Electoral Act to make rules and guidelines to ensure that every vote is counted and that every vote counts. “If INEC determines that in any part of the country, electronic transmission is not possible, it would by regulations determine the appropriate thing to do.” Tambuwal, however, commended the leadership and members of the House for the decision to invite INEC to address the House and nation on its readiness by 2023 to deploy electronic transmission technology for the country elections, seems to be a wise one. He commended the leadership and Members of the House for the decision. He further admonished them to remain on the path of patriotism and deepening of Nigeria democracy by engendering and strengthening free and fair electoral process “In any case, I still believe that the best option is to leave this matter in the hands of INEC. “We admonish INEC to be solely guided by the National interest and the desire of all Nigerians for a credible, free and fair elections in using its constitutional powers and in the deployment of error free technology.”
